Probably a lot longer than you think. Look at lawsuits against the FAA, especially when no death has occurred. Most were thrown out even in the 9th Circuit. The fact the FAA is in an NPRM, will have an effect to delay any ruling. Combined with the legal process, between Federal appeals and Supreme Court, don't hold your breath. I'm not saying the rule isn't going to change, I just think IMO that it's going to be a while.

The widow who sued the FAA over the death of her husband settled over 4 years after the suit was filed. Look at the history of the certification of the DC-10 and the lawsuits that surround it.

I am not here trying to promote websites, but the age60rule site does contain a copy of the complaint filed by Bothwell and Hassan. It is an interesting read, particularly the list of names of the class action members. A lot like voyeurism, although I do not know anyone on the list. One comment I'd like to make to the attorneys, however, is for someone in your office to proofread the complaint. There were some minor errors. I know that's one of the many things I look at when I have to read complaints.

The website also has the Amicus brief by Woolsey. He claims that the Supreme Court rejected his brief because it was submitted by a non-attorney. I am curious as to the "JD" denomination he places after his name. And I must say, this brief was rejected not because of the reason stated, but likely because it contained even more spelling and grammatical errors than the complaint!

This is serious business, folks, and attention to detail is everything these days.
