As to S 65 and H.R. 1125: Both were incorporated as Sect. 706 of the 2008-2011 FAA reauthorization Bill -- S 1300, short title "Aviation Investment and Modernization Act of 2007." (So noted and available on my website under the title (in red) "2007 FAA Appropriations Bill:")

2 points:

S 1300 does have to pass for the FAA to have money for its operations. But not necessarily with Sect. 706 -- either as it is currently worded, or as it may (or may not) be amended. THEN, a companion Bill must pass in the House - with or without the same wording as passes in the Senate. THEN, there must be a conference between the House and Senate to reach a "final" version of the reauthorization Bill. THEN, the "final" version will be voted on by each chamber. THEN it goes to the President for his signature. Sect 706 can be amended and/or deleted in any of the first three of the above processes. Maybe, even, in the fourth. (Civics 101.)


I DO NOT HAVE A COURT CASE PENDING.


There are at least 3 court cases pending: the Senior Pilots Coalition (at least 1, maybe more), Oksner v Blakey et al, and Carswell v ALPA, US Air, & AFL/CIO.


I ONLY REPORT ON THE CASES OTHERS HAVE FILED AND BEEN MADE KNOWN TO ME.

So this process may take as long, if not longer, than the method of NPRM that Blakely is proposing to get the rule changed!?
