The Fight For Pilots Hurt By New Age 65 Rule

Now that U.S. airline pilots can fly to age 65, litigation is now moving forward to overturn wording in the 2007 law that also specifically barred some 3,000 pilots forced into retirement before age 60 from being rehired with their prior pay, position and benefits. Congress last year passed the Fair Treatment for Experienced Pilots Act that raised the mandatory retirement age for pilots to a more internationally recognized age of 65, but wording in the law excluded some 3,000 veteran pilots forced to retire between November 23, 2006, and December 17, 2007, from being rehired at their previously held seniority levels. George Washington University law professor Jonathan Turley has brought a motion to have the U.S. Court of Appeals determine the constitutionality of the congressional law before it can be used to dismiss petitions filed on behalf of those pilots forced into retirement. "That motion allows the court to review the law faster than it would have otherwise," according to a posting to LegalTimes.com blog.



"The law arbitrarily strips pilots of their position, seniority, and benefits at the age of 60," Turley said.

Let's just get rid of the age limit all together. Then we can bring back every retired pilot to every airline that is still in business and restore their seniority and longevity. Then, I'm going to start a company adding more of those people mover go-carts in airports to haul around geriatric pilots. Brilliant!

Enough is enough already.

They should make the minimum age 30, and maximum 60.

At least that will keep the ipod wearing spikey haired brats out of the right seat and clear out some of the crusty old farts in the left seat.

This will not affect ups or fdx because none of our pilots were forced out. They all the option of staying but voluntarily retired.

Staying at a lower pay scale (FE) is not the same as staying as a captain. They will argue that they were forced out of their jobs and they probably do have a point if this thing is succesful

They were offered back seats at 140000 a yr, they weren't forced out at all. This will not change a thing for the guys at fdx and ups. Just like the guys who took voluntary retirement at the other airlines are out of luck.

One could also argue that since the older guys stayed working, it will force the younger guys to be furloughed in the next round. If someone that knew they were supposed to retire and then changed the rules can sleep at night knowing they got theirs while another guy got furloughed, then more power to them. I know that I wouldn't want anything to do with it.
