Well, we fly 91 when we reposition and don't have charter customers onboard. Pretty sure you can shoot the approach but you'll have to circle if it's really socked in or at night. Not the best solution if you can help it.

It doesn't make any difference. Check your Operations Specifications (Ops Specs) as they dictate what a carrier can and cannot do.

We operaterate under FAR Part 121 and even if we are repositioning an aircraft for a charter, with no passengers, it's still Part 121 rules for Ops and MX. Your P.O.I. and the FSDO issue the Ops Specs and they become "the law" for your carrier.
