Default Just busted a TFR. Any advice?

Our fearless leader was in a nearby town and TRACON said I was 6 miles into the TFR area. FAA is telling me it is an AUTOMATIC 30-90 day suspension for first time offenders--no questions asked. Could this be right?

Yes, it sounds realistic.

NASA form and get a lawyer -- hopefully you're in AOPA if you're flying GA and you can tap their legal resources if you are.

What kind of flying were you doing??? Did you by any chance call for a briefing...and specifically ask about TFRs??? Sometimes the briefers dont know. I had a briefer tell me once that they werent sure and that I would have to call center to find out. Good luck.

Do the NASA form, but if the FAA really wants to nail someone, they will claim that the violation in question was intentional, which invalidates the nasa form.

Flying without getting a brief might well be considered an intentional violation.

If you got lost or mis-navigated, that would be un-intentional.

I always save my DUATS printouts for that reason.

Since the prez was involved, assume they will come with both barrels...if you need your ticket to make a living, get a lawyer.

Ditto on the NASA form and the attorney. If you are not part of a legal plan but are an AOPA member, call them for a referral anyway. It will be worth the time and fee that you might pay to get your stuff in order.

btw, the FAA publishes an enforcment guidance table of sanctions for almost all violations. It's in Appendix B of FAA Order 2150.3B and the table penalty for a TFR is indeed 30-90 days.

Whether it will be imposed at all, where in the range (or outside) it will fall, whether the FAA attorney will accept the NASA waiver, etc, are all made on a case basis and is a very good reason to consult with a lawyer who understands the system

Thats a good article. I work at a flight school within the Crawford TFR and it's surprising how many pilots fly into it and don't comply with the restrictions when it's active.

File a NASA form if you have not already.

If you claim to have recieved a briefing prior to the flight, call the FSS and see if there's any way you can get a copy of the tape.
