Default FDX Return from long term MLA

I've been out on mil leave for almost 7 years now. Long story. I'm going to tell FDX I'm avail on May 1st for 757 initial training (previous 727 F/O). I've looked at the contract and it says FDX will find me a training date within 30 days of my return date. Has anyone had any experience with this? What are the odds I actually get a training date by June 1st? Thanks in advance...looking forward to coming back.

Welcome back and thanks for your service!

They have to comply with the CBA. I'd check w others who've returned from MLA, like you are doing, and call FDX ALPA, PAC/Fleet Capt, and Crew Staffing and gather the info.

Take a look at your relative seniority for WB F/O; vacancy and excess going on around your return timeframe ... with your seniority you may hold a decent percentage in the WB and save yourself a training cycle.

I think there's an ALPA Military Affairs rep. I bet they would be up to speed on all of the required hoops that both you and the company are required to comply with.

Although I'd use it as a last resort (the company may simply be inclined to comply with all the requirements), the Vice Admiral Chief of the Navy Reserve is currently a FedEx pilot on military leave.

I bet you won't have to get her involved ...

The Labor Department has ruled that (in accordance with USERRA, for long term Mil leaves > 180 days), that the employer has 2 weeks (14 days) to return you to a pay status, once you notify them of your intent to return to work.

So if you tell FedEx on/before April 16 that you want to return to work on May 1st, then they must pay you from May 1st onward. If, for example, they cannot get you in to a training class until July 15th, you still get paid from May 1.


However, If you tell them on May 1 that you want to return to work ASAP, they are not obligated to put you back on the payroll prior to May 15.

The CBA may provide for additional benefits, but may not reduce your rights under USERRA

Didn't quite do that long, but just came back from about 6 months. They had me starting 2 days after I told them I was coming back. I believe they will want you to go through another BI at some point. Within about a month of coming back you definitely want to contact the PAC and give them a return date. They will start coordinating with training, the vacation folks, etc... I think getting in touch with them that early was key in getting a quick training date... Good luck and welcome back!

Dammit! Y'all are supposed to be retiring, not coming back and pushing me to the bottom!!!!

Welcome back Steve.

I once heard the time gone that requires BI again but I don't remember what it is. I'm sure seven years was more than what I heard.

Were you able to get an AD retirement after those seven years?

I'm out on extended SCK leave. I was told recently that if you miss 1 training cycle that you get "the short course" and if you miss 2 or more cycles you get the whole sha-bang including BI ...

I returned from a 7 mos stretch - plan on training when you tell them your returning. Your pay starts then so I would plan on starting within days of your notification. USERRA affords transition days following your service based on length of service. That is on you. When you give FDX a return date they assume you've accounted for your legal time off.
They won't order your iPad (huge problem) until return date. Recommend you have it shipped to a local FDX office in Memphis so you can use it/learn it during training. FDX sent mine to my home which made it useless and painful not to have, esp during IOE. Also, PAC helped with passport and FAA med repayment - not entitled until "return date", but silly not to do beforehand. Those were the big things - welcome back.

Steve,

They gave me the first training date available after my return date, so I wouldn't expect to wait long.

Once you give the company your 30 day notice, expect an email or call from crew staffing. They will let you know what you could have held while you've been gone. You will then get to chose your aircraft. If I remember correctly, they will give you training dates. All were within a week of my return date. So, in short, I'd give them the day you actually plan on going to work. I wouldn't expect them to give you very long on the payroll waiting for a training date.

Just remember they will put you in first class available even if you can hold something better.
