i tend to agree that the crew over stepped a bit here.... however...

I also think that flying, driving etc... are NOT rights.. they are activities in which those who partake agree to operate within a set of rules. Operate outside the rules and you get spanked. I am NOT a fan of TSA and in fact they are one reason I left the airline world for the corporate end of things. Article 9 does not grant you the right to drive... or fly......

Oh? So everything is black and white huh? Does such thinking make it easier for you since your simple view fits into one neat and clean package? Apparently you're one of those extremists that think everything that is not laissez faire capitalism is Marxist communism. Give me a break.

About a month ago we had a simular situation with a person taking a picture and video during a pilot lav/clear zone/swap with fa. The FA requested he delete it and wouldn't. When we got to our destination police met the aircraft, as the passenger got up he took the memory card out of his pocket and placed it into his pocket. When he was escorted off and to some nearby seats he would not give the police any information or simply erase the pic/vid. This then required the TSA security officer (not screeners) to put in a call to the FBI to resolve this isssue.

From talking to the TSA guy after the flight crew have the right to request deletion of any photographic (pic/vid) items deleted if taken on the plane or of the plane. Additionally, you are required to obey any instructions made by a uniformed crew member involved in duties conducting flight.

Clear case of JB's flight attendants trying to bully the lady into deleting what could be seen as "bad press" (although, on a plane full of New Yorkers, what do you expect?). As for the captain demanding she delete the film: I'm gonna have to call BS on that one. Flight attendants picked up the interphone, "called" the Captain, and then told the lady to delete the film per Captain's orders.

As for her getting arrested, pfft, what a bunch of nonsense! And the cop not wanting to give her his name or anyone else who was involved? Sounds a lot like he was trying to CYA for the Charlie Foxtrot they were involved in.

Overzealous employees trying to protect the company and now look where they got themselves.

Well, no I do not see everything in black or white (nor do I see it in only red or blue colors).

I reread my post and realize now that maybe my words were a little harsh toward you which I apologize for. I still disagree with many of the things you'd said in the past regarding our "illegal aggression" in Nicaragua, etc however I also realize it should be ok for us to have totally opposite views and be able to discuss things. So again, sorry for my previous post.

Well since the thread has pretty much stopped I will indulge in a little thread drift.

Herk I have to disagree with you. The courts have addressed this question as to whether driving is a right or privilege many times and you will find decisions going both ways. However, generally speaking most agree the notion of driving as privilege comes from the fact that using the highways for profit is a privilege and using them for personal use is a right. This has somehow been bastardized into the notion that driving is a privilege and not a right.

Lots of states have addresses this and there are lots of examples, but here is one from the Washington State Supreme court:


"Complete freedom of the highways is so old and well established a blessing that we have forgotten the days of the Robber Barons and toll roads, and yet, under an act like this, arbitrarily administered, the highways may be completely monopolized, if, through lack of interest, the people submit, then they may look to see the most sacred of their liberties taken from them one by one, by more or less rapid encroachment." Robertson vs. Department of Public Works, 180 Wash 133, 147.

If you read the whole decision he clearly says driving is a right.

The bottom line is the government will keep saying driving is a privilege and not a right until everyone accepts it as true. The reason; governing a privilege is far easier than a right. The real crime is; they are now trying to use driving as a punishment. For example, several states now take away driver license for minor crimes. If they allow people to believe it's a right, there is no way they could do this.
