Well since the thread has pretty much stopped I will indulge in a little thread drift.
Herk I have to disagree with you. The courts have addressed this question as to whether driving is a right or privilege many times and you will find decisions going both ways. However, generally speaking most agree the notion of driving as privilege comes from the fact that using the highways for profit is a privilege and using them for personal use is a right. This has somehow been bastardized into the notion that driving is a privilege and not a right.
Lots of states have addresses this and there are lots of examples, but here is one from the Washington State Supreme court:
"Complete freedom of the highways is so old and well established a blessing that we have forgotten the days of the Robber Barons and toll roads, and yet, under an act like this, arbitrarily administered, the highways may be completely monopolized, if, through lack of interest, the people submit, then they may look to see the most sacred of their liberties taken from them one by one, by more or less rapid encroachment." Robertson vs. Department of Public Works, 180 Wash 133, 147.
If you read the whole decision he clearly says driving is a right.
The bottom line is the government will keep saying driving is a privilege and not a right until everyone accepts it as true. The reason; governing a privilege is far easier than a right. The real crime is; they are now trying to use driving as a punishment. For example, several states now take away driver license for minor crimes. If they allow people to believe it's a right, there is no way they could do this.
