The NT also reports that despite Gannon's claim of severe emotional distress caused by the incident, he has subsequently failed to report any such condition on FAA medical questionnaires, raising a point with potentially serious consequences: Either Gannon lied in his legal claim, making his suit little more than frivolous harassment - or lied on his medical form, violating FAA regulations
Oh oh... is there a $250,000 fine in mr. Gannon's future?

Well, I obviosuly wasn't there, but since I do the walk around, I make the call and capts have always gone with my judgement. If I see frost, we get sprayed...period! Certainly if anyone in the crew had concerns, I would say do it also. Most F/A's are not pilots but I wouldn't do something that the capt was not comfortable with...F/A's are part of the crew as well. And not for nothing, Im pretty sure Cactus crews were paid by the hour back then!

If there's any question by either the F/O or F/A's, then the captain can easily confirm or refute that. The frost is either there or it isn't.

True. I guess what Im saying is I wonder why the F/O made such a stink of not wanting to get sprayed. It wasn't just the F/A's...the guys in the deice truck also voiced concern about it.

True statement... in Canada if the deicers, which are considered to be technicians, raise an issue about ice on the jet then get deiced. They make a notation in their daily records for operational reasons.
