Default Scope problems ahead ?

Couldn't decide whether to post this on "Major" or "Regional" site, since it involves both. Think it refers to the DAL scope clause. From a newsletter I receive-

This was just put out by RAH management team. This will now make scope violation #2 this year! Under the scope language only the CPZ planes were allowed to be over the 86,000lbs. Whats the response to this going to be by our MEC? It appears that management is testing the water on how the pilot group will respond to Scope issues. At what point is enough enough? UAL and Midwest are finding out the extremes of scope deterioration as we speak. Scope effects everyone from the top to the bottom. Whether it be flying, upgrades, commutes, jobs, or career earnings we are all effected by this. Below is the memo that was just put out to the RAH pilot group:

New ERJ-175 Weights To: All ERJ-170/175 Crewmembers
From: XYZ
Date: March 19, 2009

Re: New ERJ-175 Weights POH Bulletin 170-09-02, effective April 1, 2009, establishes new (higher) ERJ-175 weights for the Delta ERJ-175 fleet. The issue that has come up is that for the next several weeks, Shuttle America will be operating a mixed fleet of aircraft that are both pre-mod and post-mod for Service Bulletin 170-00-0016. In meetings today with the FAA, it was decided that Shuttle America will operate the entire ERJ-175 fleet using the most conservative (lower) weights until such time as the entire fleet has been modified with Service Bulletin 170-00-0016. We will post a notice when the entire fleet has been modified with Service Bulletin 170-00-0016 and at that time the flight crews will be permitted to operate the ERJ-175 aircraft at the higher weights. Please give me a call at 317-******* if you have any questions.

New weights: MRW 89,352 up from 85,870
MTOW 89,000 - 85,517
MLW 75,177 - 74,957
MZFW 70,547 - 69,886

CPZ is Compass and RAH is Republic Air Holdings, two of NWA's (now ours, I guess) RJ operators. I believe the JCBA only allows Compass (with whom we have flowback provisions) to operate jets over 86,000 lbs MTOW (§1.B.40).

And because of the fierce outcry from the DAL pilots filling their reps e-mail in boxes, this little plan has been put in indefinite hold.

Simply put, you want to fly that darn jet with a MTGW of 89K it need to be where in benefits mainline jobs. Our list comes to mind, but some will argue that the same thing can be accomplished by giving those jets to CPS. Problem with that is, it keeps a nice cheap B-scale of the list.

Probably the same "some" that want CPS separated from the DAL MEC.

I heard that due to the Delta scope that another memo went out saying that the modification was now not going to happen.
