Anyone know where the penalty phase of the TWA/ALPA lawsuit stands?

If you mean "damages," well, the liability portion is on appeal isn't it?

The parties could agree to resolve it at any time.

My guess anywhere between ten minutes from now and never, with "never" being more likely.

ALPA has not filed an appeal to the liability portion that I know of.

The parties are currently in mediated talks to produce an agreement on damages. It was ALPA that proffered mediation, and the TWA pilots agreed to it. This agreement by the TWA pilots to be a party to mediation has suspended the damages phase of this lawsuit. If the parties can't agree on their own, then the damages phase resumes in court.
