Default Mortgage Forgiveness Law

This might help some of you. Sorry I'm a bit late with posting this.

The act, signed into law Dec. 20, is intended to provide temporary tax relief to homeowners who might lose their home to foreclosure or who negotiate a loan modification.

Previously under the country's tax code, if a lender--voluntarily or involuntarily--forgave a portion of a borrower's mortgage debt, the forgiven amount had to be treated as taxable income. Credit unions and other lenders had to file Form 1099-C, "Cancellation of Debt," to report to the Internal Revenue Service any debt of $600 or more cancelled or forgiven.

The new law allows the discharge of indebtedness on loans up to $2 million and secured by the borrower's principal residence not to trigger federal income taxation. PL 110-142 covers only discharges made between Jan. 1, 2007 and Dec. 31, 2009.

jesus, why is the government bailing out Financially irresponsible people....................

Yes the mortgage companies are scum but a little research would have told you, you probably would not be able to afford it in 3 years

I agree. Isn't anyone familiar with the term "buyer beware" anymore? Seems like it's ALWAYS someone else's fault when things don't go right, never their own. For the life of me I still cannot figure anyone's logic who bought at the peak of the boom in say, Stockton CA, a house for $500,000 who thought it was going to be worth 1 million in a year (seriously, in Stockton? right...). And then when the house actually looses half it's value, well then let's just walk away from the house and let the banks and taxpayers deal with the mess. There's no point in me staying here if I can't make my money!

It's the American way. Run your credit to the hilt buying more than you can afford with your house and car and kids private school and then cry about how it's not your fault and get the media involved. Those of us who saved and don't have 10,000 sqft homes and new cars get to bail these idiots out. I guess that we could all move to Sweeden, at least there you know from the start that you are in a socialist country.

Well at least next time the banks want to do this again, they'll know they have our tax money to bail them out. The best thing long term for America would be if Bank of America and Wachovia folded. Historically you can see that credit caused the great depression, the FDR admin. prolonged it by Keyes' economics, and WW2 bailed us out for a price we still have not paid to this day.
