Just an update for those who care.

I have come to the realization through more careful reading that the reg in question specifically applies to amateur-built and kit-built light-sport aircraft with experimental certification in particular. Whole lot of worrying about nothing. The aircraft I fly does not fall into this category.

Actually, that regulation specifically points to the certification of the aircraft, insofar as its airworthiness certificate. Experimental.


§91.319 Aircraft having experimental certificates: Operating limitations.
(a) No person may operate an aircraft that has an experimental certificate—

(1) For other than the purpose for which the certificate was issued; or

(2) Carrying persons or property for compensation or hire.



The purpose and limitations of the airworthiness certificate is spelled out on the back of the certificate. What is cited on the back of the aircraft that you fly?

The original post was because I was concerned with subsection (e) ; which I failed to realize is regarding aircraft certified under part 21.191 (light sport aircraft).

Regarding section (1) and (2) [for compensation or hire], good question, I will have a look at the cert. Regarding compensation and hire, I think you did an excellent job of detailing that earlier.

Although the replies you are getting may contain sound advice, none of them are official by any means. I would highly recommend you ask for a legal interpretation.

Update.

Spoke with AOPA's pilot information center. After a few days they sent me a response with their OPINION, gleaning a great deal from a letter of INTERPRETATION regarding a similar situation from 2013. (All-the-while advising me that only the FAA has authority to issue such INTERPRETATIONS and such INTERPRETATIONS only legally apply to those for whom they were made)

They too, think that insofar as the flying is done in accordance with the certificate the aircraft was issued, and insofar as the flying is only done with company personnel and equipment INCIDENTAL to that company's business, not for compensation or hire; then I am PROBABLY legal to operate their aircraft for compensation as a commercial pilot.

They advised (as others here have) that I must comply with section (1) and (2) BOTH.
