Agreed - if it's above my seat, it's my bin space. But, if someone makes a fuss about you using EMPTY bin space above their seat that they clearly have no need for, then that's a problem. To me it makes more sense to put my bag there than to delay the flight while they have to check it and toss it down below, which would have been the only other option because literally every other bin was full with belongings and stacks of money and "business cards" and all the other things people leave Vegas with
