I agree with what you're saying 100%, BUT... I do think that when they really do get short you could see them trying to extend people with threats. I think that they would violate status quo to put a band aid on things to get through peak. Then they could stop before the courts would rule they were violating status quo. Many would be forced to do what was being demanded by management as opposed to explaining some sort of disciplinary action in a potential Spring interview.
I'm not saying 100% that does happen but don't be shocked if it does at some point. They're going to react to the situation in a manner that fixes the problem temporarily for them. That I'm sure of...
