Walking around inside the Capitol building, carrying zip tie cuffs, during an alleged insurgency during which multiple people died isn’t really minor. They could recall him and try him under article 134 for multiple charges, including felony manslaughter. If anything, they could do it to him as a senior officer in order to make an example of him. Civil charges probably wouldn’t result in loss of pension and medical benefits, but a courts-martial could.
