As part of the NDA, both pilots unions cannot negotiate with Parker for any changes for the duration of the NDA. Should AMR and U come to terms on a merger, then the APA/U CLA becomes the new contact for AA pilots (one of the more likely scenarios I considered in a previous post).
At that point it gets interesting. Do USAPA and the APA negotiate a joint contract or only the surviving union ?

Actually, the first paragraph is. If a merger is announced while in BK and Parker submits a POR and it's approved, then AA pilots contract issues are set for the duration of the C11 or until otherwise agreed to. Mandatory binding arbitration if AA pilots don't agree to certain aspects of the CLA.
As far as subsequently negotiating a single CBA and SLI for all3 pot groups after BK, that I don't know.

I think you will find that after Judge Silver rules there will be only two pilot groups that we will be talking about.
As soon as a merger plan is announced any union can file for single carrier status. The courts have held that the merger does not even have to be consummated, just on track. So the APA can file and become the pilot union for both sides very shortly after any merger is agreed to.

USAPA will be gone once the American pilots file for single representation vote, APA will win hands down. The numbers control the vote, that is exactly what happened with the east vs west pilots. Overnight the west lost their own union, own MEC and got folded into the new union while negotiations were still going on. This time (if it happens- a big if) will be no different. APA will represent the U pilots in negotiating a new agreement- completely legal and in compliance with standard labor law.

Do you think Judge Silver will rule before we see if other events occur? I think she read the paper where Dougie said this could solve the east/west issue and slid our case to the bottom.
I think the MOU will pass. I'm hearing that west guys don't like it because the PHX protections are gone. Any thoughts that your would like to publicly share? More east opposition because the feeling is "why should we have to give up anything else?"
