Not exactly. All the courts have ruled on is what USAPA can propose. What they will be held accountable for is what they actually implement. In other words, the courts have not taken away the rope with which USAPA will hang itself.

You are correct, the rope is still there. It always will be. They also have the entire case laid out, all their mistakes to review and an all around second chance. Can they pull it off? I have no idea, but they've gotten farther than either of us thought, haven't they?

Ok, I'll take a crack at this...
After completion of the proposed/intended merger, including a final AA/US SLI, the AOL group sues for damages.
The court will ask " how were you damaged"?
West answer: Well your honor, as former AW pilots, our career expectations to retire from a DOMESTIC/ NARROW-BODY airline, making substandard wages, have been denied..
We are now forced to work for a GLOBAL CARRIER with the prospect of upgrading to a wide body aircraft, making a substantial amount of money, with incredible opportunities available to our group (west pilot group)..
We will not go quietly as 19 yr. F/O's are allowed to leapfrog our 5 year F/O's towards capt. upgrades.
Therefore WE DEMAND that the windfall we so cherish (Nic award) be immediately implemented at the detriment of thousands of other pilots who were employed at the time most of us were still in HS!!
Judges answer: Ahhhhh NO!! Case dismissed due to merritt and common sense..Have a nice career and may God have mercy on your soul!!

Is the company blocking it now? We are parked. Aren't they doing the exact same thing?

Cacti, I know you love you victim status, but there was no way that in the Spring of 2007, with the Nicolau award fresh and the Kirby insult just delivered that a joint contract would have passed. NONE.

Like I told you I think pulling out was a mistake. Heck, I wish we had put the Nic inclusive Kirby out for a vote, that's how confident I am. But in the end it made no difference.

The transition agreement allowed this mess, no matter what the method. The west didn't have issues with dual ratification then because you guys thought YOU would come out on the short end of the stick and would have to use it to delay a implementation of a joint sli until the attrition kicked in. Now you whine about it. Integrity.

Yes..And?? The Nic derailed any chance at a combined cba...ALPO failed miserably in choosing the path of least resistance. Therefore, they were REPLACED..

I thought so. A concerted effort to stop a contract was undertaken by the east pilots. Now you can use whatever excuse you want for doing it but that is a fact. You actively harmed the west, something you continue to this day. Like I said, I can accept a scum bag management doing it but there is only one word that describes pilots that do what the east has done.

Lets say that you "Cacti" sits down to sign the 36 mons. lease on your new Corvette. But before you sign on the dotted line, you notice that the extra mileage will be charged at a greater rate than verbally agreed... Will you sign the deal and hope to later correct the issue, or will you abstain until the PROBLEM is fixed??
