It's surprising to me that the DOJ would write the complaint in a way that would eliminate a settlement between the two parties. They either believe that when they sued that AA/US would pull out like most mergers they oppose. Or do they believe they can win in court?...maybe a ace up their sleeve? I'm just a dumb line pilot but I can't believe they wanted to go to court over this and fight it out....especially after AA/US got the November court date. Is a 25th hour settlement possible days before trial?...That will be my guess...but I also thought the merger was a slam dunk.

At this point it all seems like a game of poker. Why not say that if your the DOJ and raise your bluff a little. Who knows.
