Seniority List Integration Update

"The Seniority List Integration (SLI) arbitration panel has provided a confidential draft award to the three SLI committees and the Company for review and comment. The Seniority Integration Protocol Agreement allows for the delivery of a confidential draft followed by a comment period of 10 business days. Initial committee comments are due to the panel no later than July 5, 2016. Each party will then have five business days to reply to submitted comments. Specifically, Paragraph 13 of the Seniority Integration Protocol Agreement states: “Prior to issuance of the final award, the Arbitration Board shall issue a draft award to the parties for their comment concerning issues they identify in the award. The parties shall submit any comments within 10 days of receiving the draft award. The parties may submit any response to the comments of the other parties within five days of submission of those comments. No new evidence may be presented in either submission.”

The SLI panel also issued an order on Monday, June 20, 2016, affirming the confidential nature of both the draft award and the comments to the draft award. The order clearly confirms that each committee and the Company must keep the draft award and comments confidential. Neither the draft award nor the comments will be published.

Three seniority integration committees — the East Pilots Seniority Integration Committee (EPSIC), the West Merger Committee (West Committee), and the AA Pilots Seniority Integration Committee (AAPSIC) — are participating in the SLI process, each representing the pilots on the respective pre-merger seniority lists (US Airways East list, US Airways West list, and American Airlines list). The Company also participates in the SLI process as a party. The three committees and the Company are bound by the Seniority Protocol Agreement and the panel’s order to keep the draft award and comments to the award confidential.

APA is neutral and did not advocate for any proposed integrated seniority list (ISL) because it is the collective bargaining agent for all of the pilots flying for the new American Airlines. The APA National Officers and Board of Directors have not received a copy of the draft award, and APA will not be reviewing the draft award for comment.

The SLI arbitration panel consists of arbitrators Dana Eischen, Ira Jaffe, and M. David Vaughn. SLI arbitration hearings concluded in January 2016, and post-hearing briefs were filed by each of the three seniority integration committees on March 28, 2016. The panel activated its Technical Assistance Team (TAT) in May to assist the arbitration panel in producing a fair and equitable ISL. TAT members have been assisting the arbitration panel on a variety of technical matters. TAT work-product was also confidential and produced for the arbitration panel. Each of the three seniority integration committees provided two people to serve as TAT members."
