IIRC - isn't FWI a 0.04 BAC or does it differ too?
I noticed the original article referenced the regular 0.08 for driving - though it did mention operating a vehicle

The officers tested Roessler’s blood-alcohol level an hour after he landed; it measured .109 percent. The legal limit to operate a vehicle is .08 percent

Well he was obviously drunk off his rear, but the thing that stands out to me here is that breathalyzers are poor science in general and these arresting officers administered the test repeatedly as time went on. The case is weak without actual blood tests and skilled lawyers can defeat breathalyzer evidence. This is guy is history as a pilot though.
