Flight instruction count towards 121 max?
 
I’ve just gotten permission from my employer to flight instruct on my time off but it’s up to me to make sure all stays legal as far as max flight times per month, quarter and so on.
I’ve seen it come by here before just can’t find it.
There’s an FAA council ruling that flight instruction is NOT considered additional commercial flying and as such doesn’t count towards the 121 regs.
Anybody care to point me in the right direction ? Thanks.
And no it’s not because I don’t make enough, need a new contract or trying to avoid food stamps.

If you’re under 117, flight instruction doesn’t count. If you’re under the commercial flying clause of the older 121 rest rules, there’s a FAA interpretation that it is considered against the limit.

Be careful about getting the ruling around medical (instruction might not count as commercial) confused with the rule on rest. The medical ruling was limited to that part. Open to hearing from others though. I believe that under 121 instruction counts with some exceptions (instructing as part of guard / reserve duty times etc).
