For you guys that have been around a peak or two. Can UPS run peak with an OT/JA ban?

barely?

i guess we'll find out if they furlough, because they will then have the ot/ja ban over peak if we have pilots on furlough.

With the exception of this past peak, UPS has run peak with a lot of subcontractors and a very lean pilot staff. OT and JA made it happen in the end, I suspect.

It's actually an interesting legal question... one I hope the IPA labor attorney will look at. The meaning and intent of the contractual language that allows the subcons during peak (in my opinion) implies that UPS can't cover required lift during that specific period with its own workforce and requires relief via the subcontracting. Now, if UPS has created (or contributed to) a shortage through furlough, I think hiring subcons violates the meaning and intent implied by the language. AT A BARE MINIMUM the IPA should get everyone on furlough during peak paid their minimum guarentee for each day a subcon is used.

I agree, in general UPS is willing to go into uncharted territory by furloughing and using subs for peak, but more importantly nonunion labor for union work coming May 22nd. Unfortunately it appears to me our contract specifically allows for subcontracting during peak with a furlough. I am not a lawyer but it appears if they subcontract with furloughs it just can't be with a/c UPS owns.

Now I fully expect a legal %hi&storm over the Ms doing MEF after May 22. I suspect the union begging for M flying data has a lot to do with this.
