No "sale, lease, transfer", etc, took place. "...any other disposition..."? Legaleze and all... Additionally, ATI has had that particular aircraft on the certificate for many years, so the "upon acquisition" part kind of falls flat, too. I'm confident our IBT and ALPA lawyers are all over this. We'll have a solution in about 15 years.

Like I said, I don't have any issue with ATI guys getting this work.
My concern is that it is a violation of the scope agreement between ABX pilot group, ABX and DHL.
Have you ever wondered why ATSG hasn't merged ATI and ABX yet? It makes sense that they should.
Hete obviously wants to do whatever it takes to avoid recalling ABX pilots until all the recall rights expire. Just look at the number of planes on the ABX certificate compared to the number of planes on the ATI certificate.
At this time, Hete is recalling to ATI while violating scope to avoid recalling ABX pilots. I think he is doing whatever he has to do to get by for another year so that he can start getting new hires at ABX. When that happens, I wouldn't be surprised if he will start moving assets from ATI to ABX and furlough all the guys he just recalled at ATI. In that scenario, Hete wins and everyone else loses.
I'm happy for the guys getting recalled to ATI but I think it will be only a short term situation.
That's why it's very important for the ABX EXCO to vigorously defend this scope issue.

Muddy waters? Perhaps. Violation of ABX scope? Talk with DHL, as this is how they run this one. Personally, I'd just as soon NOT run through BNA. One leg to the hotel is fine by me!

As far as the SCOPE goes... It's very confusing. As a former ABX and former ATI guy I still have trouble figuring out what complies and what doesn't as cities are shuffled around and aircraft go in and out of heavy checks. It's almost as bad as deciding which side of the ISL fence a recall should come from!

Regarding recalls, ATI is recalling only to support a new run that has been in the works for a number of years. ATI has turned away so much work in the past two years because of not having enough crews that it is simply sad. Now ATI doesn't even have a dedicated sales department. Work that was supposed to come to us has been funneled off to ABX numerous times, as we have come to understand it. The tiny number of recalls has nothing to do with so-called extra flying in CVG. Under what ever agreement ATI is operating PHL this week, it is at our expense, not to our advantage.
