Crewmembers are not required to keep Personal Communications
Devices (PCD) “on” during a Rest Period. A Crewmember shall notify the
Company if his PCD becomes inoperative or is not in the Crewmember’s
possession.
c. The Company may attempt to contact a Crewmember during a Rest
Period as set forth below:

(i.) By any means for the purpose of notifying him of a personal or
family emergency or a threat to his security; or

(ii.) Via a message left on the PCD, silent fax or a note under the hotel
room door for the purpose of changing the Crewmember’s
assignment or report time.

Tax Deferred Savings Plan
Crewmembers can participate in the Company’s 401(k) savings plan (“The Plan”) upon
the completion of ninety days (90 days) of service. The Plan allows Crewmembers to
make self-directed investments consistent with the Plan’s offerings. The Company will
match one hundred percent (100%) of the first five percent (5%) of compensation
contributed by the Crewmember, but the maximum Company matching contribution will
not exceed ten thousand dollars ($10,000.00) annually.
B. Vesting Schedule
A Participant’s salary deferral contributions are always 100% vested, while Company
contributions to a Crewmember's 401(k) account will be vested in accordance with the
following schedule:

SECTION 17 – SCHEDULING
A. General
1. Duty Day
a. A Crewmember’s duty period shall commence at 0001Z on his first Day
of duty of the Bid Line assigned or awarded.
b. A Crewmember will be required to report to the location of his first duty
assignment within the contiguous forty-eight (48) states as directed by
the Company by 0500Z.
c. A Crewmember will be released from all Company duty by 1900Z on the
last scheduled Day of duty at a location within the contiguous forty-eight
(48) states as directed by the Company.
d. Time spent by a Crewmember in transportation exceeding five (5) hours
going to or returning from the location of his scheduled duty assignment
is considered a Commute.
e. A Crewmember will be paid 6 hours of pay or the actual hours flown,
whichever is greater, if on the last scheduled Day of duty the
Crewmember is not returned to a location within the contiguous fortyeight
(48) states by 1900z and has not returned to his Resident Airport
by 2359Z.1
f. In lieu of Day off pay, a Crewmember may coordinate with Crew
Scheduling to drop sufficient Days from his current or subsequent bid
period.
g. A Crewmember’s duty period will end at 2359Z on his last scheduled
Day of duty.
1 Section 17.A.1 requires that two (2) criteria be satisfied to entitle a Crewmember to six (6) hours. First,
the Company must have failed to return the Crewmember to a location within the contiguous forty-eight
(48) by 1900z. Second, the Company must have failed to return the Crewmember to his Resident Airport
by 2359z. In the event that the Company returns the Crewmember to a location within the contiguous
forty-eight (48) by 1900z or to his Resident Airport by 2359z, the Crewmember shall not be entitled to six
(6) hours. Furthermore, the parties agree that any time that a Crewmember elects (rather than being
directed by the Company) to travel by any means other than travel by commercial airline travel provided
by the Company, the requirements of Section 17.A.1. as to returning a Crewmember to his Resident
Airport by 2359z shall not apply to the Company. Finally,
The parties agree to the following administrative example: A Bid Line may be published with duty days
from the fourth (4th) to the twentieth (20th) of the month and the first (1st), second (2nd) and third (3rd) in
this example are not subject to the five (5) day minimum. Conversely, a Bid Line may be published with
duty days from the 11th to the 27th and the 28th, 29th and 30th are not subject to the five (5) day
minimum. However, if a Bid Line is published with 2 separate sets of duty days (a split line) the days off
between those 2 separate sets of duty days are subject to the five (5) day minimum.
h. If travel does not commence before the Crewmember’s duty period
ends, the Crewmember will be paid 6 hours of pay per Day until the
Crewmember is returned to his Resident Airport.
i. The Company shall provide all transportation from a Crewmember’s
Resident Airport to the Crewmember’s duty assignment and returning
the Crewmember to his Resident Airport. Company provided
transportation for this purpose will be limited to/from the Crewmember’s
Resident Airport located within the forty-eight (48) contiguous states,
Anchorage, Alaska (PANC) and Honolulu, Hawaii (PHNL).
2. Delays and Cancellations
When the Company provides transportation to an assignment for a
Crewmember, the Crewmember will not be responsible for delays or
cancellations beyond his control.
3. Resident Travel to Base for Training
Resident Airport travel shall not apply to Crewmembers in Training. All travel is
considered a Commute when traveling to Base for any required training.
4. Travel Between Home and Resident Airport
Crewmember travel between home and Resident Airport, including but not
limited to, mileage expense, tolls, parking and other related expenses shall be
the responsibility of the Crewmember.
5. Travel Between Resident Airport and Base
A Crewmember who travels from his Resident Airport to his Base for an
assignment (except for Training) will receive resident travel. A Crewmember
will also receive per diem and hotel accommodations once at his Base for an
assignment or for Recurrent Training.
6. Resident Travel
Travel from Resident Airport to First Duty Assignment
a. A Crewmember must make positive contact the Company between 0500
and 1900 YIP local time on the day immediately prior to his last
Scheduled Duty Free Day Off (SDFDO) for his travel arrangements. For
purposes of this Section 17.A.6.a, “positive contact” means a telephone
call or email from the Crewmember to the Scheduling Department;
provided, if the Crewmember sends an email, the contact does not
become effective until the Crewmember receives a confirmatory email
from the Company describing his duty assignment. The Company shall
not unreasonably delay sending confirmatory emails. A Crewmember
must contact the Company in accordance with one (1) of the options,
below:
(i) If a Crewmember contacts the Company for his travel
arrangements between 0600 and 1500 YIP local time on the day
immediately prior to his last SDFDO, then for purposes of
Section 17.A.6.b, “available” means “a coach class ticket is
available to the Company’s Travel Department by utilizing the
then current airline contracts with the Company and then current
reservation system at the time of contact plus one (1) hour.”
(ii) If a Crewmember contacts the Company for his travel
arrangements between 1501 and 2000 YIP local time on the day
immediately prior to his last SDFDO, then for purposes of
Section 17.A.6.b, “available” means “a coach class ticket is
available to the Company’s Travel Department by utilizing the
then current airline contracts with the Company and then current
reservation system at the time of contact plus two (2) hours.”
b. If (A) there is one or more commercial airline flights (non-stop or one (1)
or more connections) scheduled to depart from a Crewmember’s
Residence Airport between 0001Z and 0500Z and available as
described in Section 17.A.6.a.i or Section 17.A.6.a.ii, whichever is
applicable; and (B) the scheduled arrival time for such flight(s) is at or
before 0500Z at the location of the Crewmember’s first duty assignment
within the contiguous forty-eight (48) states on his first Duty Day, the
Company shall:
(i) Schedule travel on a commercial airline flight (non-stop or one
(1) or more connections) that satisfies condition (A) and
condition (B) in Section 17.A.6.b; or
(ii) Schedule travel on a commercial airline flight (non-stop or one
(1) or more connections) that departs from the Crewmember’s
Resident Airport on his last SDFDO, subject to the conditions set
forth in Section 17.A.6.c.
c. If the Company schedules travel pursuant to Section 17.A.6.b.(i) or
Section 17.A.6.b.(ii), the Company shall:
(i) Select the scheduled commercial airline flight (non-stop or one
(1) or more connections) on the Crewmember’s last SDFDO that
is closest in time to 0001Z with a scheduled arrival time at or
before 0500Z at the location of the Crewmember’s first duty
assignment within the contiguous forty-eight (48) states on his
first Duty Day unless the Crewmember agrees otherwise.
(A) Notwithstanding the above, if the Base Price of the
scheduled commercial airline flight (non-stop or one (1) or
more connections) closest in time to 0001Z exceeds the
cost of the Base Price of any scheduled commercial
airline flight (non-stop or one (1) or more connections)
that departs no earlier than four (4) hours prior to 0001Z
by fifteen (15) percent, the Company may schedule the
Crewmember on any such flight. The Base Price is
defined as the lowest price available to the Company’s
travel department by utilizing current airline contracts with
the Company and the reservation system used by the
Company.
(ii) Log the Crewmember’s time spent in travel (scheduled departure
time to 0001Z) for purposes of 4 hours pay or a compensatory
day off, whichever the Crewmember elects, as set forth in
Section 17.A.6.d.
d. For purposes of Section 17.A.6.c.(ii), the Company shall log all time a
Crewmember spends in travel (scheduled departure time to 0001Z) in
quarter hour increments (e.g., forty (40) minutes of travel time results in
thirty (30) minutes of logged time; one (1) hour and forty (40) minutes of
travel time results in one (1) hour and thirty (30) minutes of logged time)
e. When a Crewmember’s accumulated logged time, under Section
17.A.6.d equals twenty-four (24) hours, the Crewmember shall be
entitled to 4 hours of pay or a compensatory day off, whichever the
Crewmember elects, as set forth below.
f. When a Crewmember’s accumulated logged time equals twenty-four
(24) hours, his accumulated log time will reset (e.g., if a Crewmember
spends two (2) hours in travel as described above, and the two (2)
hours of travel results in accumulated log time of twenty-five (25) hours,
the Crewmember’s accumulated log time on the following day is one (1)
hour).
g. When Crewmembers accumulate twenty-four (24) hours of logged time,
the Company shall notify affected Crewmembers via the Company’s
Crew Bids website. The information will be posted when bid packages
are distributed. Crewmembers that elect to use a compensatory day
must notify the Company by email no later seventy-two (72) hours after
the close of the bid whether he will use the compensatory day off at the
beginning or end of his awarded or assigned line(s). A Crewmember’s
failure to make an election under this Paragraph results in the
Crewmember receiving 4 hours of pay by default.
h. The 4 hours of pay referred to in Section 17.A.6.e shall be paid no later
than the second pay period following the expiration of the election
period referred to in Section 17.A.6.g.
i. If there are no commercial airline flights that comply with Section
17.A.6.b and Section 17.A.6.b.(i), the Company may schedule travel on
a commercial airline flight that departs from the Crewmember’s Resident
Airport on his last SDFDO. In such a case, the Company shall:
(i) Select the scheduled commercial airline flight (non-stop or one
(1) or more connections) on the Crewmember’s last SDFDO that
is closest in time to 0001z with a scheduled arrival time at or
before 0500z at the location of the Crewmember’s first duty
assignment within the contiguous forty-eight (48) states on his
first Duty Day unless the Crewmember agrees otherwise (If the
Company schedules a commercial airline flight under this
Section 17.A.6.i.(i), Sections 17.A.6.c.(i), 17.A.6.c.(i).(A),
17.A.6.c.(ii), 17.A.6.d, 17.A.6.e, 17.A.6.f, 17.A.6.g, and 17.A.6.h
shall not apply); or
(ii) Notwithstanding the above, the Company may select a
scheduled commercial airline flight (non-stop or one (1) or more
connections) on the Crewmember’s last SDFDO that departs no
earlier than four (4) hours prior to the scheduled commercial
airline flight (non-stop or one (1) or more connections) on the
Crewmember’s last SDFDO that is closest in time to 0001z with
a scheduled arrival time at or before 0500z at the location of the
Crewmember’s first duty assignment within the contiguous fortyeight
(48) states on his first Duty Day. The Company shall have
sole discretion in the selection of any scheduled airline flight
booked in the four (4) hour window under this Section 17.A.6.i.ii
regardless of any difference in the Base Price of the tickets.
(iii) If the Company schedules a commercial airline flight under
Section 17.A.6.i.(ii), the Company shall log the amount of time
between the scheduled departure of the commercial flight closest
in time to 0001z under Section 17.A.6.i.(i) and the scheduled
departure of the commercial flight the Company schedules under
Section 17.A.6.i.(ii). For purposes of this Section 17.A.6.i.(iii),
the Company shall log the differential in quarter hour increments
(e.g., a forty (40) minute differential results in thirty (30) minutes
of logged time; a one (1) hour and forty (40) minute differential
results in one (1) hour and thirty (30) minutes of logged time).
When this Section 17.A.6.i.(iii) applies, the Company shall also
apply Sections 17.A.6.e, 17.A.6.f, 17.A.6.g, and 17.A.6.h above.
However, Sections 17.A.6.c, 17.A.6.c.(i), 17.A.6.c.(i).(A),
17.A.6.c.(ii) and 17.A.6.d shall not apply when this Section
17.A.6.i.(iii) applies.
j. Nothing contained in Section 17.A.6 prohibits the Company from
scheduling travel on a commercial airline with a scheduled arrival time
after 0500Z.
k. If the Company assigns ground transportation from a Crewmember’s
Residence Airport to the location of the Crewmember’s first duty
assignment within the contiguous forty-eight (48) states on his first duty
day (e.g., a limo from JFK to DOV, a Company car from YIP to Oscoda,
MI), and the ground transportation commences between 0001Z and
0500Z, the Crewmember shall not accumulate logged time under
Section 17.A.d. However, if ground transportation commences prior to
0001Z (e.g., the limo service requires a departure prior to 0001Z, the
rental car service requires a pick up prior to 0001z), the Crewmember
shall accumulate logged time under Section 17.A.6.d.
Travel from Last Duty Assignment to Resident Airport
l. If travel from the Crewmember’s last duty assignment to his Resident
Airport does not commence (i.e., start or begin) prior to 2359Z, the
Crewmember shall receive 6 hours of pay per Day or a compensatory
day(s) off, in lieu thereof, whichever the Crewmember elects (or
combination thereof in the case of multiple Days) until the Crewmember
is returned to his Resident Airport unless:
(i) The travel would have commenced before 2359Z and the
Crewmember declined the travel (e.g., the Crewmember
preferred to travel on Delta Airlines instead of US Airways); or
(ii) The travel would have commenced before 2359Z and the
Crewmember elected rest (i.e., received a hotel room and per
diem) prior to commencing the travel; provided, the Company
arranged for travel in accordance with the following and Section
17.A.6.l.(iii):
(A) The Company shall arrange for travel to a Crewmember’s
Resident Airport in accordance with the following steps,
which shall be applied in descending order:
(1) The Company shall arrange for non-stop travel
when it is available and does not exceed the cost
of one-connection travel by more than fifteen (15)
percent.
(2) If non-stop travel is not available or the cost of
non-stop travel exceeds the cost of oneconnection
travel by more than fifteen (15)
percent, the Company shall arrange for oneconnection
travel when it is available and the
scheduled connection time does not exceed two
(2) hours.
(3) If one-connection travel is not available or the cost
of one-connection travel exceeds the cost twoconnection
travel by more than fifteen (15)
percent, the Company shall arrange for twoconnection
travel if the scheduled connection
times do not exceed two (2) hours for each
connection
.
(4) If only non-stop travel and two-connection travel
are available, the Company shall arrange for twoconnection
travel if the cost of non-stop travel
exceeds the cost of two-connection travel by more
than fifteen (15) percent and the scheduled
connection times do not exceed two (2) hours for
each connection.
(B) All comparisons of cost of travel in Section
17.A.6.l.(ii).(A).(1) shall be based on Base Price. The
Base Price is defined as the lowest price available to the
Company’s travel department by utilizing current airline
contracts with the Company and the reservation system
used by the Company.
(C) When arranging travel under Section 17.A.6.l.(ii).(A)(2),
(3) or (4), the Company shall utilize the same carrier or a
code-sharing partner, unless it is not possible to do so.
(D) All "connection times" referenced in this Section 17.A.6.l
are connection times on the commercial travel arranged
by the Company and not connection times between the
arrival on the Company aircraft and the commercial travel
arranged by the Company. Furthermore, the
aforementioned connection times will not apply to
connection times between international destinations.
(iii) If the Company cannot comply with Section 17.A.6.l.(ii).(A), as a
result of no flights being available, a labor dispute, weather, flight
cancellations, or overbooking by the airline that prevents the
Crewmember from boarding the aircraft, or any other cause
outside the reasonable control of the Company (e.g., power
failure), the Company shall arrange for travel in accordance with
the descending order provisions of Section 17.A.6.l.(ii).(A) unless
one or more of the conditions referred to herein makes it
impossible to do so.
m. If the Company cannot arrange for travel in accordance with any of the
steps set forth in Section 17.A.6.l.(ii).(A), for a reason set forth in
Section 17.A.6.l.(iii), the Company shall remain obligated to arrange for
travel; however, a Crewmember that elects to take rest prior to
commencing travel to his Residence Airport shall not be eligible for 6
hours of pay per Day or a compensatory day(s) off under Section
17.A.6.l.
n. A Crewmember that elects a compensatory day(s) off in lieu of 6 hours
of pay must notify the Company of the election within seventy-two (72)
hours after arriving at the Resident Airport. The failure to elect results in
the Crewmember receiving 6 hours of pay.
o. A Crewmember shall use a compensatory day(s) off under this Section
17.A.6 at the beginning or end of his awarded or assigned line(s) during
the bid month or during the next bid month; provided, a Crewmember
who elects to use a compensatory day(s) off during the next bid month
must notify the Company of the day(s) on which he will use a
compensatory day(s) off no more than forty-eight (48) hours after the
close of the bid award. The aforementioned notice is in addition to the
notice required under Section 17.A.6.n.
p. Pay for a compensatory day(s) off shall be considered a credit towards
the Crewmember’s monthly Minimum Bid Period Guarantee.
q. When a Crewmember uses a compensatory day(s) off, the
Crewmember shall continue to be subject to the line guarantee
provisions in the Agreement.
r. A Crewmember that receives pay or compensatory days off under
Section 17.A.1.e of the Agreement shall not be eligible for pay or a
compensatory days off under the last sentence of Section 17.A.1.h of
the Agreement, and vice-versa.
7. International/Bases
If the Company desires to establish any Base, outside the contiguous United
States and the District of Columbia, the Union and the Company will meet to
attempt to agree upon the changes necessary in this Agreement prior to
establishing such a Base. If after sixty (60) Days the parties are unable to agree
upon the changes necessary in this Agreement to establish such a Base, the
Company may establish the Base and the parties will refer the issue of what
changes are necessary to interest arbitration. Prior to such referral, the parties
will mutually agree upon an appropriate set of ground rules for such arbitration.
The Railway Labor Act and all provisions of this Agreement shall apply to all
International Bases.
8. Scheduling Committee
Bid packages will be provided to Scheduling Committee members prior to
publication. The Company will consider recommendations of the Scheduling
Committee concerning scheduling policies and procedures.
9. Military Duty
When a Crewmember has military duty of fourteen (14) Days or less, he must
bid all Bid Lines that accommodate such military duty. Days of military duty will
be considered a SDFDO. If a Crewmember is unable or fails to bid around his
military duty, he will be assigned duty Days that will not conflict with his military
duty requirements.
10. Required Records
The Company will keep a record of all bid packages and Bid Line awards or
assignments, and bid request forms for thirteen (13) bid periods.
11. Notification of Appreciable Delay
The Company will notify a Crewmember of any appreciable delay in excess of
one hour of his departure time as soon as practical after the delay becomes
known.
B. Bid Period
A Bid Period will consist of a Month as defined in Section 2 (Definitions).
C. Multiple Bid Periods
The Company may include up to three (3) Bid Periods in one (1) Bid Package
(excluding transition Days).
D. Bid Line Construction
1. Lines of Duty
The Company will construct Bid Lines that may contain Layover Days, Reserve
Days, Days of Duty, Days Free of Duty and Transition Days as set forth in this
Section 17.D. All Bid Lines will be constructed to commence and terminate
within the contiguous forty-eight (48) states.
2. A Bid Line cannot contain:
a. More than sixteen (16) consecutive Duty Days.
b. More than sixteen (16) Duty Days in a Bid Month
3. Scheduled Duty Free Days Off
a. Minimum Scheduled Duty Free Days Off
Bid lines will contain a minimum of fourteen (14) SDFDO in a thirty (30)
Day bid Month and fifteen (15) scheduled Days free of duty in a thirtyone
(31) Day bid Month.
b. Minimum Consecutive Scheduled Duty Free Days Off
The minimum SDFDO required above will be scheduled in a maximum
of two (2) blocks of SDFDO, with a minimum of five (5) Days off in any
block. The five (5) day minimum SDFDO block does not apply to lines at
the start and/or end of a bid period.
c. Contact on Scheduled Duty Free Days Off
A current and qualified Crewmember is not required to maintain contact
with the Company on a SDFDO, except when required by Section
17.A.6.
4. Hard Lines
Hard Lines of flying shall contain all known flying at the time the Bid Package is
published. Hard Lines may consist of blocks of Duty Days, Trips associated with
Duty Days, Deadhead associated with Duty Days, Layover associated with Duty
Days, Transition Days and blocks of SDFDO.
5. Composite Line
The Company may construct Composite Lines that will be blank when
published. The Crewmember will indicate their preferred scheduled SDFDO.
Five (5) Days after the bids are awarded the Crewmember will be notified of his
Line of Flying. A Composite Line may only contain reserve Days at the end of
the Bid Line or the front of a Bid Line if it is a split line. A composite line may
also contain all Reserve Days if no flying is available.
6. Reserve Line
The Company may construct Reserve Lines containing SDFDO and Reserve
Days.
7. Transition Days
The Company may construct Trip Sequences that continue from the current bid
to a maximum of six (6) Days into the subsequent bid period. Time flown in the
subsequent bid period will be credited in that bid period. During Bid Line
construction, Transition Days will not be designated as Reserve Days, but
Transition Days may be subject to trip reserve assignment. If the Transition
Days cause the Crewmember to have fewer than the minimum Scheduled Duty
Free Days set forth in Section 17.D.3. SDFDO, the Crewmember may exercise
his options of Section 17.K.4 (Excess Days).
8. Layover Day
The Company may construct lines that contain Layover Days. A Layover of
twenty-four (24) hours or greater will be counted as a Crewmember’s One in Seven if the Company notifies the Crewmember that the Layover Day is a One and Seven prior to the start of the Layover Day. A Crewmember on Layover status will be required to contact Crew Scheduling once every twenty-four (24)
hours beginning from the time of his assigned Layover status unless Crew
Scheduling directs the Crewmember to make contact less frequently. The
Company may direct the Crewmember to perform duty during a Layover Day. The Crewmember will receive a 4 hour credit towards his Bid Line guarantee or the actual hours flown, whichever is greater, only if Crew Scheduling actually
assigns him a trip or reserve status (R3) or reserve status (R2) at the time of contact; otherwise he will remain in Layover Day status.
8. Minimum Number of Lines
The number of Bid Lines available for bidding shall be equal to or greater than
the number of eligible bidders by Type and Crew Class for the Bid Month.
E. Bid Line Guarantee and Reassignment
1. The Company will assign a flight hour value to each Bid Line (except Reserve
Lines or Composite Lines) prior to the bid package being distributed to
Crewmembers. Any R-Day on a published Line of Flying will not receive the
value of a Reserve Day. A Crewmember removed from his awarded Bid Line
(other than for his own Training or vacation if he neglected to bid a Reserve
Line) will be paid the value of the awarded Bid Line from which he was
removed. To receive Bid Line Guarantee, a Crewmember must be available
and qualified to perform his awarded Bid Line.
2. When the Company removes a Crewmember from his awarded Bid Line, the
Company may assign the Crewmember to another duty assignment or a 1 in
7(s) in accordance with the Agreement. The following procedures apply:

a. Reassignment After the Last Duty Assignment of the Duty Period
A Crewmember shall check-in by email or telephone under subsection
17.N.4 immediately after he arrives at the hotel and receives a room
assignment following the completion of his last duty assignment of the
duty period. Within forty five (45) minutes after the Crewmember checksin
with the Company, the Company shall assign the Crewmember to
another duty assignment or a 1 in 7(s).
(i) The rest period begins forty-five minutes after the Crewmember
checks-in with the Company or he receives another duty
assignment, after he checks-in with the Company, whichever
occurs first. .
(ii) The 1 in 7(s) begins immediately after the Company responds to
the Crewmember check-in referred to above.
(iii) The first duty assignment after the rest period begins in
accordance with Section 18 (Hours of Service).

Subject to subsection 19.F.2.a, if business-class travel is not available the Company may require the Crewmember to travel in coach class; provided, for an International Deadhead segment, the Crewmember shall receive compensation in the amount of five hundred dollars ($500.00) or a five hundred dollars ($500.00) Travel Bank credit under Section 19.J in lieu thereof, whichever the Crewmember elects. Subject to subsection 19.F.2.a, a Crewmember may not refuse commercial air travel in coach class if business class travel (or better) is unavailable.

what is not right is you sh!tting on the product and the heads of about 10 crewmembers who volunteered their time and money to work for this pilot group
when in your life have to done a thing to help your fellow crewmembers
ever?
