What did the mediator side with us about? I thought we were waiting to hear whether they would accept our Sec. 6 mediation request or tell us to proceed with amalgamation.

It was my understanding that our mediator, Jim Mackenzie, viewed the case for mediation was valid.

"Q: What happens now that we have requested mediation from the National Mediation Board?
As an administrative matter, the NMB will assign a docket number to the case and determine that it’s appropriate for assignment of one of about 20 staff mediators. If so, one of the mediators will be assigned to the work and, over the course of the next few weeks, will contact the parties to begin meeting."

If it wasn't deemed appropriate then how did we get assigned a mediator?

Fwiw.... K4 spent 3 of our 6 years in mediation.... The NMB is not your friend. Most of the mediators have have several ongoing negotiations and will only agree to meet for a "week" of meetings... meaning really Tuesday thru thursday...sometimes friday... and NOT every month...as they have a limited budget for this stuff and the travel involved. In the best of cases its a slow process.

The has not yet been a determination of appropriateness nor assignment of a mediator, only assignment of a mediation board investigator from which there has, as yet, been no determination of which route is appropriate.
