Technically, the constitution doesn't legally apply to foriegn nationals or enemy combatants outside US territory (there are other rules for that).

As to whether we should opt to apply those protections to everybody in the entire world is a legit subject for debate. The argument for "no" is that people outside US territory are not within reach of the judicial system. If a wanted foriegn terrorist managed to get into the US, he would be arrested and subject to the same rules as any citizen... I don't think he could be sent to, or held at GITMO.

KSM is in GITMO, but his nephew was extradited to the US, got a normal trial and is doing life at the supermax (along with several notorious American bombers). KSM could have surrendered and got the same, although he might have been in jeopardy for the death penalty... 3000 counts of special murder-1, one or two of those might have stuck.

At this point I believe everyone still there is guilty as hell and deserves at least 20 years, life (or death) in most cases. They're not taking new customers, they just can't release the ones they have left.

If they're guilty, then execute them. If not, why continue running a concentration camp?

These extrajudicial prisons should not exist. As Ben Franklin said, "it is better 100 guilty Persons should escape than that one innocent Person should suffer." The story of this innocent 19 year old kid detained in Guantanamo is a travesty of justice

Or maybe, the goal was to prevent a COVID outbreak in a high-security prison in an isolated location surrounded by a hostile country. Giving the prisoners the vaccine protects the service members. While that briefs well, this vaccine is still under a EUA and the prisoners, unless they had a clearly articulable right to refuse (which the courts have ruled is pretty limited, say in sexual assault cases) could make the argument legally that they are being medically experimented upon.

A previous President campaigned on the closure of the camp at Gitmo, had 8 years to execute and yet, here we are.

Surprisingly, many of these inmates are dedicated to their cause, and when released, have returned to the fight. Many if not most were captured in circumstances that preclude a normal trial. However, most of their actions were prima facie war crimes.

I mean, we can go down the Canadian route of giving millions of dollars to war criminals from Gitmo, but I don't know if that serves Justice as much as you seem committed to doing so.
