The famous "three generations of imbeciles are enough" case is an interesting piece of American Arcana, spouted by the same justice who famously wrote about "shouting fire in a crowded theatre". Pithy quotes, Mr. Holmes, but simply awful constitutional law. Smart, powerful people can embrace very dumb, very dangerous ideas that encroach on individual liberties under the flag of what's for the "greater good". Our elites are VERY smart and highly credentialed, but they are not gods; the US still has the forms of a republic; a mere regulatory agency (OSHA) imposing it's will on 80+ million Americans will ruffle feathers. This could very well lead to a Congressional mandate, which is probably completely legal. One political party will own it, however; not sure if they're up to the task. It was sort of a model for the sit-ins they did to dramatize the stupidity of ‘colored’ bathrooms and water fountains and ‘back of the bus’ regulations during the civil disobedience days of the civil rights movement. Make penalties too small, and there was no real deterrent effect and you lost money on every case you prosecuted. Make penalties too big and you not only lost in the court of public opinion, you couldn’t get jurors to actually convict. As for getting OSHA to enforce this, I think OSHA has about 2000 inspectors nationwide, ostensibly already doing other important stuff. Getting them spun up to enforce a regulation on 100 million people every six months, ASSUMING THEY ACTUALLY GET THE RULE WRITTEN, ought to be…interesting. |

I can’t say that most business owners that this will affect disagree with it, because I don’t know all of them….but I will say that all of the business owners I KNOW that this will affect disagree with it. One has already started transferring some of his business, and soon employees, to another “company” he owns to drop the main one under 100. Another that is at around 120 employees has started taking a walk around the parking lot to see who has Biden bumper stickers in case he needs to get under 100… |

If vaccine passports are made mandatory for normal human rights (travel, work, shopping, etc), you can be certain that they’ll be applied equally to everyone.
