Constitutional scholar Jonathan Turley called White House chief of staff Ron Klain’s recent retweet appearing to praise the Biden administration for executing the "ultimate work-around" for President Biden’s recent vaccine mandate "breathtakingly daft." "The retweet was breathtakingly daft on the eve of litigation over the order. It is reminiscent of President Biden admitting that his own White House counsel and their preferred legal experts all said that the eviction moratorium extension was likely unconstitutional," Turley told Fox News on Friday. "Courts will now be asked to ignore the admission and uphold a self-admitted evasion of constitutional limits," Turley added. The "problem is that the thing being ‘worked around’ is the Constitution." What a shock! it was sort of like when Biden said the CDC extending the moratorium on foreclosures was unconstitutional, but we are going to do it anyway. That practically forced the SCOTUS to rule against it. Technically, it’s ‘an admission against interest’ but colloquially it is dumb as dirt. Science isn’t even really involved. |
TLDR version:
Biden administration official tweets that using OSHA was a way to get around Constitutional prohibitions. This will be used as an admission of clear intent to violate statutory limits. Zero about science, more about poor governance. |

Biden once equated legislating by executive order to be dictatorial. Well, he was right. This is what we have now. They will continue to overreach and make the courts stop it. Klain’s tweet was pretty stupid, but the Biden supporters will ignore it and even defend it.
