Here it comes again… The Department of Justice (DOJ) on Wednesday said it would appeal a ruling striking down the mask mandate for public transportation after the Centers for Disease Control and Prevention (CDC) requested it appeal. “In light of today’s assessment by @CDCgov that an order requiring masking in the transportation corridor remains necessary to protect the public health, the Department has filed a notice of appeal,” a DOJ spokesman tweeted. The CDC said in a Wednesday statement that “to protect CDC’s public health authority beyond the ongoing assessment announced last week, CDC has asked DOJ to proceed with an appeal in Health Freedom Defense Fund, Inc., et al., v. Biden, et al.” “It is CDC’s continuing assessment that at this time an order requiring masking in the indoor transportation corridor remains necessary for the public health,” the agency added. The announcement helps bring more certainty to the administration’s course of action after officials deliberated over whether to appeal the ruling, which was issued Monday. The CDC order requiring masks for travelers had been set to last until May 3, when many experts expected it to expire anyway. While the mask mandate will remain suspended for the time being, and likely was going to expire soon anyway, a major reason public health experts had pushed for an appeal is to preserve the CDC’s legal authority for the future. If the current ruling from a federal judge in Florida was not appealed and allowed to stand, they feared it would handcuff the CDC if it needed to reimpose the mandate in response to a more dangerous variant down the line. |

Those that want to wear masks can still do that. I still see ~1 out of 20 people wearing a mask in the grocery store here. From what I see, masks aren't very popular with the public.
If the mask mandate gets restored, it will be bad for airline revenues and the Democrats. I cannot believe the administration doesn't just walk away from this. |
At least we can look forward to the nail in the coffin for the dem’s future in November if this gets appealed.
The mask is like putting a dirty rag on your face that has wiped up every surface it has touched. Pretty nasty concept really and such a political tool |

I think the SCOTUS already telegraphed how they’ll treat this with their OSHA mandatory immunization ruling. I’m all for them taking this all the way to the Supreme Court.
Hearing the government try to justify a common standard for packed rush hour buses and subway cars versus HEPA filtered airline seat ventilation ought to be amusing. For that matter splitting the baby - First Class doesn’t require masks but tighter pitch economy does - would be a laugh as well. |
This is getting appealed to the 11th circuit which is overseen by Clarence Thomas, so thats a positive thing. So, its an uphill battle for the DOJ

Maybe when there's absolutely zero impact on cases in whatever time it takes to spool up that appeal they'll drop it.
On the other hand, this case isn't really about covid. It's about a government agency's ability to mandate whatever they want on whim without any legislative process. For your safety, of course. |
