Default Float Plane Question...

I live on a private lake in Virginia. My HOA is wondering if we can pass laws making it illegal for float planes to land on our lake, even by a legal resident. I don’t have a FP rating and was wondering if they could do that... I am against it, but being the resident pilot, I’ve been asked to research this.

I thought I’ve heard it’s basically legal to land a float plane anywhere, as long as the FAR’s are not violated.

I have no idea and can't really help, but I find this interesting! Do you have lots of float planes landing there?

The Seaplane Pilot Association https://www.seaplanepilotsassociation.org or AOPA would be the people to call. Here is a good start: https://www.seaplanepilotsassociatio...landing-areas/

The FAA doesn't care what happen on the water - that is a local determination whether a floatplane can land on the water or not.

But generally, a private lake can set it's own rules as far as I know. But an HOA bylaw might not have much enforcement ability against a non-owner. I believe that would require a actual law of some sort. But you're getting into what your state considers law, whether the HOA bylaws are laws, and it gets into the nitty-gritty pretty quick.

If they are anything like my HOA, my response would be... After extensive research I have found several freedom of use regulations and statutes that govern this and the answer is we can absolutely not prevent it. If they want to limit my rights, there's no way I'm a party to that. Next thing you know they'll come for your guns!!! (TIC, sort of)

Hopefully that ends it but if they come back after further investigation.........oops. Karen will be in touch, I'm sure.

Most places I've been are state regulated. I'm in TN. and the TVA controls my lake.

Does your HOA have a problem with floatplanes? If not why are they bothering? Perhaps they should consider banning wakeboats instead.
