Wow, missed a lot today while doing DTW-DEN-CVG-LGA.

I'm always hoping for the slot swap to go through. That's quite a but if extra flying & revenue. More heavy metal would be great too.

My interpretation of the SLI conditions and restrictions says the answer to your question is yes the replacement aircraft would be open for all to bid. Here is the applicable item from the conditions and restrictions:

5. Should the merged company take delivery of any aircraft which is/are a replacement of any aircraft covered by Paragraph 4., the captain positions and, as applicable, the first officer positions on each such replacement aircraft will be allocated in accordance with the Paragraph 4. restrictions on the type it is replacing.

Paragraph 4 is the actual fence paragraph of the award on the 777's, 747's, and 787's. As far as replacing 330's with 744's, there is nothing specific in the arbitrated decision that I could see. I'm sure it would go to the arbitrator. I was just giving my opinon and we all know what they are like!!

If the company is smart, they won't mess around with any of the fenced categories until the fences come down. There are what, two/three more years til then?

Just under 4 years... It was 5 years from Jan 1, 2010.

I disagree that if the company buys 777s to replace the 787 it will be open to all pilots to bid. The "replacement" aircraft would be "allocated in accordance with the Paragraph 4. restrictions on the type it is replacing." i.e. the new positions would go to northies.

Now if 744s were replacements for 330s you might be right about that they could possibly open to everyone. You are definitely right it would go to the arbitrator.

To all my L+G douchy bruthas, try to keep it less douchy on here. Douchiness has been discovered and will be exposed. Even more than the high level of douchebaggetaciousness on the DPA thread, the SWA/AAI windfall thread is overflowing with solid douchinsky's.

That was my point in bringing this whole subject up. We all read the same thing and come out with different interpretations depending on which side of the "fence" you are on.
