If you are only trying to avail yourself of the federal law, then yes.

The Federal Age Discrimination in Employment Act of 1967 (29 USC §621 if you are really bored after 4QCQ) "protects certain applicants and employees 40 years of age and older from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions or privileges of employment. The ADEA is enforced by the Equal Employment Opportunity Commission (EEOC)."

However, it can work the other way as well but age discrimination is only analyzed by a court under a "rational basis" standard which is pretty favorable to the rule maker. If you can come up with some/any rational reason why the rule/law should be upheld, it will likely survive.

On a more relevant note for us pilots, despite the existence of the ADEA, the Supreme Court decision in Massachusetts Board of Retirement v. Murgia is pretty much the "go to" case that established the judicial standard of review which upholds our FAA mandated retirement age.

There is an exception to the law. If a job is primarily based on physical attributes, age discrimination against older workers is permitted. For example, runway fashion models. Alas, airline pilots are not.

And yet I am willing to bet when the next class starts you will find the drop here. The guys have to talk about something in the weeks without a class starting.

I highly doubt thousands is accurate. I’m an RJ captain, I’m not taking a huge paycut 70-38 an hour to sit in the right seat of a 320. Especially when the hope of upgrade at Spirit is nonexistent. Simple math shows they have all the pilots on property they need to upgrade for planned orders.
GoJet even has a “flow” program, rumor has it only about 25 of the 500+ pilots on property expressed interest.

I'm just glad times are good enough we can complain about randomly assigned seniority numbers (SSN is random), for our weekly new hire classes for pages and pages and pages. I personally hope this continues to be our biggest issue / topic in here for a LONG time!
