Divorce/Alimony/Pension Payment QDRO
#12
Unfortunately for me looks like I’m 30 years into a marriage that’s gone to pasture. She’s filed and hired an attorney. I’m a 25 year WB captain at FedEx and she hasn’t worked in 25 years (3 grown kids). Semi-amicable and hopefully we can use a mediator. Here’s my question- I’m gonna have to pay her alimony (or whatever Texas calls it) for 10 years. The math according to Texas Statute works out to $5,000 per month for 10 years. I called the Fedex retirement center and they informed me that she’s entitled to half my pension AND she can start collecting her half the day we divorce (we’re both 57). So she gets about $5,500 per month until the day she dies from FedEx. So here’s my question - is spousal support on top of this money? If so, then she’s getting $10,500 per month for the next 10 years. Or, does this pension payment satisfy the spousal support requirements? Does anyone have any experience with this?
I'm not in Texas, so the advice to hire the best lawyer you can is excellent.
Your question is "how are the community assets divided, and what amount of support is she entitled to?"
Each state is different, but mediation is a negotiation and everything is on the table. A good mediator and responsible counsel will follow state law, but if you agree to an item, you own it.
Through mediation, you'll have to consider if you're better off having a judge impose state law in divorce trial.
The point is......go get a good lawyer.

I bought a sail boat and moved to a banana republic and lived on the hook for a few years. Helped me save my soul after the thrashing I took. Found someone younger and tanner to share my time with too.
There is light at the end of the dark tunnel that is fast approaching. Step one is hire the best of the best of the best. Why? Because we live in a society where the male of our species is always the bad guy and the female is always the vitctim under the eyes of the “law”
Fights on bub. Don’t give an inch unless you have too....you know the old adage. “Give an inch, they’ll take a mile.”
Gonna suck, I ain’t gonna kid you. Lots of support groups on line to help you through it tho. But sipping rum on your own escaped pod in the Carib helps the suck go down smoother.
You have to ask yourself, like I did......”what’s your price for freedom?” You figure that out, the rest comes easy.
I think my anchor is dragging so I gotta go check my ground tackle. Good luck.....

Seek the advice of an ERISA Attorney... a $300.00 fee can preserve more of your retirement account than you realize.

Get the advice of an attorney schooled in ERISA, then talk to the MEC Retirement Specialists. Do not sign off on the “boiler plate” QDRO letters that some attorneys push across the table for your signature (I learned the hard way 13 years ago!).
Maybe you can come up with a buy-out as an option to your A-Plan benefits?
Been there buddy!
