FedEx Pilots v. ALPA - Class Certification
UPDATE: Motion for Class Certification filed 7/12/2016
Fedex Pilots v. ALPA
- Our law firm filed the brief for Class Certification on 7/12/2016. Please read here:
Legal Documents - FedEx Pilots v. ALPA
- We've been very busy with the discovery of documents with ALPA, and ALPA has also requested to dispose the 4 named plaintiffs prior to replying to our Motion for Class Certification.
We want to dispel some rumors:
1. ALPA has never increased dues or assessed its members for legal proceedings, and we do not expect this in our case.
2. This is NOT a frivolous lawsuit and ALPA will NOT sue contributors for their legal fees.
3. All contributions are being kept confidential.
4. The lawsuit is not stopping retirement negotiations.
5. This lawsuit is about accountability.
- There will be an Amendment filed by our attorneys next week to change the definition of the "Proposed Class" to basically state "all pilots on the seniority list for the 2015 TA ratification." The current wording in the "Memorandum in Support of the Plaintiffs Motion..." does not accurately reflect the "Proposed Class".
This will include Inactive pilots (Military Leave > 90 days, Long Term Disability (LTD), etc.) and non-members who, on October 20, 2015, were members of the seniority list.
- Many pilots have not even heard of the lawsuit, or have very limited information. The website below has all of the information, please pass it on to your fellow crew members.
- We plan to have our attorneys come to Memphis in the near future to explain the lawsuit and evidence.
We request your support by contributing to this demand for accountability.

What are you paying your attorneys and what is their cut if you/"we" win?
Obviously, they aren't doing it for free. You want transparency from ALPA. We would like some transparency from you.
Don't give us some political mumbo jumbo either. Just tell us what this is costing and what their take is...simple.
It looks like a typical money grab. You were pi$$ed. You went to a lawyer and they said "great case." They make an a$$ton of money and we get jack and $hit.

Your statements are simply not true.
No one works for free, and I do not think you would hire a "dentist" to remove your "appendix".
In the Tiger merger lawsuit, the 2 law firms involved charged reduced attorney fess, to include a contingent component, just as our law firm is.
We have also limited our attorneys as to how much they can charge us, and this amount is well below what was paid to the attorneys in the Tiger merger lawsuit.
That lawsuit, against FedEx, was also won by the way, but stopped progressing due to the lack of funds at the very end. This information comes directly from a named plaintiff in the Tiger Merger lawsuit.

Allen Press and Joe Jacobson represented the TWA pilots in their Duty of Fair Representation lawsuit against ALPA National in Brady vs. ALPA. They proved what was considered would be extremely difficult to prove.
We feel confident they are the right attorneys to represent us, and they have extensive experience with ALPA and this type of lawsuit. They feel we have a valid case and that there is evidence of numerous beaches of ALPA’s Duty of Fair Representation, otherwise they would not represent us.
Jacobson Press & Fields is also currently representing the Class Action lawsuit on behalf of owners of Volkswagen diesel vehicles in the state of Missouri for the German company's rigging of emissions technology to pass air-quality tests.
We’ve agreed to a set amount we will pay Jacobson Press & Fields in return for a contingent, so there is no “bottomless pit” to attorney fees.
- We’ve also agreed upon an attorney’s rate at 50% of their normal rate.
- We’ve also agreed that any attorney fees paid will be refunded to each pilot from the contingent, if there is a judgement or settlement for damages, subject to Court approval.
- The contributions will be the first monies paid back to each pilot if there is a judgement or settlement for damages.
In Brady vs. ALPA, the contributing pilots were refunded their contribution, in addition to their individual settlement payment.
With any lawsuit, there is no guarantee of the outcome.

What do dentists, my appendix or the Tiger merger have to do with the current law suit against ALPA?
Typical "bob and weave" (distract, distract and change the subject) antics without really answering the question?
It seems like it's about time for some email hacking distractions!*?
Politicians are famous for that.

We are not releasing the limit we have agreed to pay our law firm, as we believe individuals will us this number in an attempt to undermine the lawsuit (which is already occurring). The contingent agreed upon also will not be released here on APC.
You're accusations above are not true.
What are you implying by "email hacking"?
