Default Latest CARES ruling: SY wins / F9 loses.

https://paxex.aero/2020/04/sun-country-wins-big-as-united-frontier-lose-in-latest-cares-act-ruling/

Sun Country will be permitted to collect its government funding while largely suspending service through 21 June 2020. United Airlines and Frontier Airlines will not be so lucky. The latest guidance from the US Department of Transportation released this morning shows that the Agency is using different standards for the different sized airlines in forming its policy”

tldr: SY said the big airports were already served, so they don’t have to fly there. No such luck for F9.

I'm happy for Sun County. Wish it worked out for us too.

We got $174M for basically nothing plus another $31M for next to nothing plus they haven’t even dispersed the loans yet, which I understand F9 is going to be a part of as well... the fact we got relief on 3 cities is a win and those milk routes should actually save a lot of money as well... I’ll take our spot over sun country’s any day...

Well said.

There’s been a lot of inequity observed across the board concerning the so called Paycheck Protection Program (which is actually a coloquial reference to different parts of the CARES Act). A class action has been filed today in the US District Court of Los Angeles arguing 4 big banks (remember 2007?) bypassed the first come, first served rule for loans distribution, leaving 90% of small businesses empty-handed. I doubt airlines would follow suit in relation to DOT’s Final Orders, if they have a standing at all, due to its political implications.

I believe the ruling on ULCC’s appeal to DOT - claiming the requirements for essential services were “disproportionate and unfair to air carriers that provide point-to-point operations and lack the frequency, scale and scope of legacy air carriers and their hub-and-spoke business model” - was unfair.

And, IMO, anyone concerned with his job and career is wise if truly preoccupied with these matters. In fact, the very survival of the airlines under profound stress right now is directly dependent on having a just opportunity to make good and fair use of the Taxpayer’s money that Congress approved, amongst several other factors, of course.
