Wow...this is turned into a truly crazy story.

This sounds like a possible fraud for the states attorney general to investigate and a possible wrongful termination for a personal lawyer to litigate.

Not sure how fraud would apply, unless one carrier made up facts about the pilot in question.

Wrongful termination would be a stretch. I’m guessing he was still on probation at his new carrier which made him “at will” (under the CBA). Companies can terminate without cause during this time period. The only exceptions to “at will” are civil rights claims.

Yeah this is one of those things where I understand the frustration and on a less discerning day in my younger years I could've been dude in question. I take no joy in being 'right', and honestly thought he'd get away with it at the current place of employment. Wish him the best with the other opportunities, good news is it's only ~5 year look back.

I think "discretion is the better part of valor" could be applied in both situations here. Dude didn't need to go scorched Earth, but neither did the DO. They both did, and here they are. Good news is hiring is picking up at regionals so he should get a 'mea culpa option' sooner or later.

Un furloughing a pilot to receive government funds while not compensating or employing said employee in any way. That sounds like fraud.

what was made up was that he was an employee. If he never received a paycheck from the new airline, never went to indoc, never did anything other than reserve seniority there is no way he can be terminated because he was never actually employed.

It’s a form of “ghost employee fraud”. If this is true, Trans States Holdings should be reported to the feds immediately.
