You could do that.
I do give the cop benefit the doubt, the perp had seized his taser and fired it at him. If he had been tased and disabled, the perp might have then used his own pistol on him.
Also possible the cop wasn't certain WHAT the perp was shooting at him with.
People who have never been in what is essentially a combat situation can't really second-guess how someone reacts. If you have kids, going home to your kids is front-and-center in your mind, and you're not willing to take any more chances than you have to. To call it monday-morning-quarterbacking doesn't even come close to how wrong it is.
A solution *might* be to hire "better" cops, basically look for people who are smarter and have demonstrated cool-under-pressure (military, team sports, LE experience in low-intensity jurisdictions?). Or you can try to accurately assess candidates for that potential (although we all know how well that works in airline aviation ). You'd have to pay them significantly more, because you'd be competing with other career fields for candidates who would normally go to college and be doing other things. Plenty of great cops out there, but the LCD is fairly low, especially in some places.

Weeeelllll...
Now it's reported (by the DA) that the officer kicked Brooks after he was down, while his partner stood on Brooks shoulders. No first aid was rendered. And he was shot in the back. Starting to look a little more like Rodney King than legit police work.

The DA said that Brooks never presented himself as a threat, never displayed any aggressive behavior, never posed a threat of injury or harm.
Did he watch the same body cam video that I did???
So initiating a fight with police officers, taking one of their weapons, and pointing the weapon at the officers fails to qualify as threatening, aggressive, or uncooperative behavior?

I have not seen any of the aforementioned cell phone or security footage in the news cycle. At this point, who knows if it's even true. If that did occur, I can't see how it changes the fact that the guy assaulted the officers, stole a weapon, and fired it twice as he began to flee.
