They got away with it because the pax oceanliners were long gone, and nobody cares if a cargo ship carrying insured US good sinks outside CONUS.
Different stakes for airline pax, and airliners operating in and over the US. I don't think even the GOP would seriously consider it, other than a couple of rabid anarchists.
The article references Europe, but we kind of already have their system... a TX based airline can operate flights within CA, and vice versa.
As for Argentina, they're not exactly a shining beacon of much of anything. Assuming business-as-usual, I'd tend to assume somebody down there got bought off to facilitate this innovation.
