Legal: FA lawsuit paid outside of block times

Several years after a Federal District Court certified a class of 1,400 Virgin America flight attendants who alleged that their employer violated numerous California state labor laws, U.S. District Court Judge Jon S. Tigar has granted them summary judgment. The flight attendants claimed that they were paid based on a “block time” schedule, which would begin when they arrived at the gate, and end when they left the gate. This meant that they were not paid for time spent writing up incident reports before and after flights, undergoing mandatory training, taking required drug tests, and waiting for passengers to board and deplane. They also allege that they were not provided with accurate wage statements. The flight attendants have now prevailed in their motion for summary judgment, and the case will proceed for the limited purpose of establishing exactly how much they are owed. If I fly: - one 8 hour leg I work 9:15 hours and get paid 8:00, easy day. - 8 one hour legs with 30 min turns I work 12:45 and get paid 8:00, hard work. - two 1 hour legs with an 8 hour sit I work 11:15 and get paid for 2, horrible. Some of this is resolve with rigs, but i would still be much happier with something like: Every hour of movement = one hour pay (on a per minute base) Every leg = half hour of pay Every hour of FDP - 1/2hour/leg while not moving = quarter hour of pay Add trip/duty rigs. |

Our FA’s are paid 15 minutes at their pay rate for their work during boarding and deplaning.

Not to mention that it's a nightmare to change your duty off time in the case you had to stay beyond 15 minutes after shutting down. JETCRW should allow you to modify your duty on/duty off time without having to spend 1 hr on your personal/un-reimbursed cell phone to perform an employer related task. Likewise, if you have to write a report of any kind or come in to talk to a CP, that too is duty and you should be paid for it. They pay you for pee tests and online training yet not for other things. They are picking and choosing and they should not be allowed to get away with that. And... FAs always take longer than 15 mins, particularly with "blue turns". They too have no mechanism for documenting extra minutes. If they were government workers, they would be suing the government for even a single extra minute of work (this is not an exaggeration!). We have to stop subsidizing our employer through personally sponsored corporate welfare. If you can't run a business paying your bills, it's a badly run business.
