Default Kalitta Air discrimination lawsuit!

I just saw this on Facebook! Reading the complaint now! Wow.

It’s about time a group of pilots and mechanics stood up to Connie and his henchmen after all these decades of discrimination and abuse.

Godspeed gentleman! Send them scattering for cover like the rats they are!

“If you or someone you know was harmed, injured, coerced, or discriminated against by Kalitta Air, you may be covered in this class action complaint. Contact lead attorney John Sullivan at the contact information listed below”.

Sounds like the TV commercial for Camp Lejune!

Decades of abuse? Give me a break, they are suing because of the Covid vaccine, not abuse.

I poop you not. Ever since I got the shot, I have felt like complete and utter poop. This was all a hoax. Good on them. I know one of em on the list, and he’s a stand up guy. I hope they win big.

That is part true. One of the guys suing is because when he got covid ( I know these from a credible source) , he had to call sick afterwards due to the side effects (remember initially during pandemic) people didn´t know about your body´s weakened immune system and other organs being affected, some people took 2 months to fully recover others different timing. Well this was the same case but K4 fired him without proper procedure. No proper procedure was followed and afterwards when the attorney on behalf of this crewmember tried to contact 3 people involved in the process, K4 stated they no longer worked there. Turns out they are still there. That I believe is gonna get someone from HR into trouble, not a law expert of course.

You are correct, they are suing because of the Company's hard stance on the Covid Vaccine. First it was because of a government contractor "mandate", but when that fell to the way side, they doubled-down and forced the vaccine for "safety". The point that you are missing is that there is a culture of abuse and retaliation. It's been hidden behind the "Family First" (as long as you are in the circle of trust). But as soon as you take a stance, whether it be the vaccine, safety, scheduling, etc... you are tossed aside and labeled.

A lot of good men and women that were dedicated to Kalitta were put on the street because of their medical and religious objections. From the pilots' perspective, 200% open time was offered to cover the trips that could have otherwise been crewed by these crew members that were fired. A few bit on it, but after the Union objected, they were targeted too.

To understand Kalitta management, is to liken it to an abusive relationship. Go along, get along. The moment you object is the moment you are subjected to abuse.

Kalitta's reputation was always the worst ACMI to work for but when they got their new contract and pay rates many thought Connie had turned a new leaf and the new Airline was a kinder, gentler Kalitta air. Also every other airline that let people go because of religious or medical exemptions has called their employees back. Only Kalitta Air still refuses to bring back their discriminated employees. Good for these guys I hope the judge rules in their favor!

It's not just those who were terminated. Certain employees still on the payroll would also be entitled to damages. The scope of the putative class includes anyone who rescinded his or her "exemption" and got the shot under duress. Arguably, they suffered more injury than those who refused to get the shot. They will have to live with that decision every day. The potential damages from this class action suit are staggering and won't be the typical lawsuit that Connie will settle out for pocket change. This will be the lawsuit of his lifetime. One of the plaintiffs' lawyer just handed United's best attorneys a crushing defeat in the Fifth Circuit Court of Appeals. Plaintiffs will ultimately seek at least four subclasses when they move for class certification: (1) employees who sought either a religious or medical accommodation (or both) and who could have been reasonably accommodated by Kalitta but were placed on unpaid leave pending termination instead; (2) employees who abandoned their exemption from the mandate because of the company’s unlawful actions that violated either their Title VII or ADA rights (or both); (3) employees terminated from the company who were entitled to a Title VII or ADA exemption but did not seek an exemption through Kalitta’s process because the “accommodation” announced from the outset was inevitable termination and those employees were (rightly) afraid of retaliation by the company for seeking an accommodation; and (4) employees who were forced out of the company—either by termination or involuntary retirement—because Kalitta regarded them as having a disability due to their lack of vaccination, even though they were not a danger to others.
