They probably want YOU to call them because if THEY call, they have broken your rest. |

As far as the company is concerned....no. Its prob a grey area as far as the FAA is concerned, though I must say I never ran into this in my years as a Pt135 driver. We were not required to call the company until we were on duty. |

Part 135 duty day is 14 hours. Are you part of a scheduled or nonscheduled operation? Is it nonscheduled/continuous on call? If so, then it is up to you to decide when duty starts. Transportation that is "local in nature" can still be part of your rest. Therefore, if you have a 2 hour call out, you do not necessarily have to start duty when you are called. I believe that it is your discretion.

A company phone call during your rest period does not reset your rest/duty clock since you voluntarily answered the phone, once.

Well my company says is not duty. We are a cargo feeder with scheduled departures but using non schedule regs... But if this a gray area answer to these scenarios:
1) When do i stop drinking Beer? 8 hours before call in or showtime?... 2) If i am required by the company to wake up at 5:00 am to call to say that i will be there at 7:00 isn't that disturbing my rest... The Fars only explain the max 8 hours of flying and the 10 hours of rest in 24 being reduced to 8 (thats where i say that 16 hours of duty can be applied). But nothing on call in as part of a duty????? And yes i am REQUIRED to call them. |
It is not duty but it is not considered rest.
For the 121 world, short call is not duty but you are not considered on rest either. If they assign you a trip, the max day is 16 hrs from the start of the short call period. I guess what you are looking at is up for interpretation. I would ask your POI. I guess it is like me having to check my schedule on my off day prior to my work day. |
