Default Southwest Pilot Codeshare Language

There seems to be a fair amount of confusion on other threads regarding SWA's codeshare language. I'm posting it for reference here.

Domestic Codeshare

Southwest Airlines will not enter into a domestic Codeshare Agreement within the fifty (50) United States without the agreement of the Association.

3. Codeshare for Regional Aircraft Flying

Southwest Airlines will not enter into any domestic or trans-border code share agreement with a regional carrier or involving a regional aircraft except to provide inter-island service within the Hawaiian Islands or inter-island service within the Caribbean Islands.

4. Near International/Trans-Border Codeshare

a. Near International/Trans-Border Codeshare will be defined exclusively as Codeshare flights that include a trans-border segment between Canada, Mexico or the Caribbean and a SWA city in the continental United States.

b. The combined total trans-border segment ASMs flown by SWA Near International/Trans-Border Codeshare partners pursuant to Near International/Trans-Border Agreements with SWA shall not exceed a total of four (4) percent of the total ASMs flown by SWA in the previous calendar year, excluding ASMs flown by SWA on Near International/Trans-Border flights, as measured on a one for one ASM basis, to include each common city pair.

The measure of SWA ASMs will be calculated using the ASMs reported in the SWA annual report unless another method is mutually agreed upon by SWA and SWAPA.

5. Other Codeshare

The Company will not enter into any other Codeshare and/or Marketing Agreement (to include far international Codeshare flying) unless expressly delineated above, without the agreement of the Association.

No problem. There is no prohibition for selling tickets on another airline through our website as long as there is nothing suggesting that the ticket is on SWA. A connecting itinerary is different matter.

Sounds/looks right to me. Hopefully some folks will read this and it will clear up the whole "AirTran is a subsidiary of SWA and flying for SWA as a codeshare is against the contract" crap that I've heard in the past.

This is the relevant section of the LOA that modified Scope:

A. Changes to Section 1, Scope and Related
1) Paragraph C.5. and 6. – Notwithstanding anything in this provision to the contrary, Southwest and AirTran may enter into code share and other marketing, partnership, operating or management agreements and arrangements in order to facilitate network connectivity, brand awareness and merger of the two carriers into one operation, so long as any such agreements and arrangements are consistent with and in compliance with this Agreement and the Parties’ Seniority Integration Agreement.

I believe SWAPA waived their code share agreement with regard to AirTran and SWA could in fact have code shared with AirTran. It gave SWAPA a lot more power in the SLI process so it suited both management and SWAPA.

A side letter altered section 1 specifically relating to the AirTran acquisition, without the side letter any code share with AT beyond a 24 month window specified in the mergers and acquisition section, would have needed SWAPA approval.

Pending any period of
separate operation prior to operational merger and integration of collective bargaining
agreements and pilot seniority lists, which shall be no longer than twenty-four (24) months,
unless mutually agreed upon by the Company and the Association, the successor shall keep
separate the flight operations of the carriers and will not transfer or interchange crews,
equipment and/or routes between the carriers unless otherwise negotiated and agreed to by
the Association, and shall ensure that all Company aircraft on hand or on order at the time of
the transaction are operated only by pilots on the Southwest Airlines’ Master Pilot Seniority
List.
