Leave earned after AT/ADT 30 days
 
As a reservist and if you do greater than 30 days of active duty (AT or ADT) in a row, you are entitled to 2.5 days of leave.

Our personal gurus have explained that you cannot take leave while you are on active duties orders, so either you have to save it until you are mobilized or sell it back. If you sell the leave back, you don't get BAH, BAS, or retirement points for those days.

How do other services/commands handle this type of leave?

I think you meant "personnel" guru, not one that was soley for your reference. ;)

That aside, I've encountered this several times in the USAF Reserve. I have been allowed to take leave my last two days of duty (although I was on 32-34 days of orders); and a half day was sold-back (when a fraction applied). I'm not sure which service you fly the Herc in. This may be USAF or even unit-specific.

I don't believe you can "save" leave until your next 30-day order or deployment, which means it is "use it or cash it."

I would like to think of the personnel gurus as my own personal gurus, but that is another thread all together.

When you say "allowed to take leave" are you taking official leave that you are getting charged for, or basket leave? If it's basket leave, then you will still have the days on your LES. As for official leave, I am told is that you can't take leave while on reserve active duty orders. Either it's not allowed, they have don't have a system in place to account for it, or they are full of B.S.

BTW, this is a Navy Reserve unit.

"Real" Leave
 
It was "real" leave. I went home 2 or 3 days early, but got paid like I was still there.

You can't carry over earned leave from one block of active duty orders to the next. I've taken leave or sold back.

If you have the orders arranged back to back, you can carry leave over - otherwise it is use or lose (or sell back). In the USAF, if the leave is taken it has to be used within the start/end days of the orders - and the official answer is that you have to be back in the squadron local area at the end of the leave to sign back in (i.e. no going home early and staying there - officially).

Conversely, at my unit, you are on the bad boy list if you don't use your leave. They don't like paying back leave at the end of orders.

Most of our guys would like to get the two days of leave, so they get the 2 point and the allowances, but we are told that they don't write reserve orders to take leave. I.E., when you are done with your work, go home. You aren't getting paid for time off.

I guess I am fishing to find out why and can prove they can't deny the leave.

In the AF we have AFI 36-2619:

8.4. Man-day tours longer than 30 consecutive days will accrue leave of 2.5 days per month. Compute tour lengths by rounding off to the nearest whole number for tours that do not end exactly on a number divisible into whole months. Tours should not be approved for less than three days when travel is outside the commuting distance of the ARC member.

8.5. Accrued leaves must be taken during the man-day tour and are included in the tour length. ARC members may request leave from their active duty supervisor through their assigned payroll office.

8.5.1. If unusual circumstances preclude taking accrued leave, the ARC member is entitled to be paid for the leave up to a career maximum of 60 days.


I am on orders right now and have taken leave with no problem.

If you have done 30 day or more blocks of orders and have been denied the opportunity to use your leave, it looks like your unit owes you some paid vacation - Navy or AF.
