ANG Pilot Transfer
 

I wanted to see if I could get an accurate idea if what my unit is telling me is true.

I have been a traditional member of the Guard for about 7 years, 6 years post UPT. For almost half this time I have lived where my Guard unit is and the other half supported a solid one day drive to commute to and from my civilian job.

About a year ago I got picked up by a major airline and have been supporting the citizen soldier concept since then, while driving 9 hours a week to get to my civilian job, no direct airline flights from my unit location.

Recently I started talking to another guard unit, in the state where I have my civilian job, and they seemed interested in possibly hiring me as a traditional member.

My commander has told several of us over the years that in no way will he allow any of us to transfer to another unit. Can my commander really stop me from transferring out of state? What about if I move to that state?

I obtained a copy of my service commitment and it clearly states that my service commitment is to the ANG not to the ANG of my state. I even talked to my unit JAG and they agree that my commitment is to the ANG as a whole, not to my state.

I appreciate any feedback, this is not an easy issue to gather information on. If anyone knows of any source document that supports my case that would be very helpful.

Yes, you can change units and after 6 years it shouldn't be an issue. Not sure about the ANG, but the Reserves have a rule about the gaining unit will take you and can carry you as an overage due to reassignment. There is a distance associated with the rule and, somehow 4 hour drive time, rings a bell. Guard might be tougher to deal with, though.

Sounds like you have a CO with a Napoleonic complex. You might write a letter to the ANG IG asking if he can prevent your transfer. That might have the IG in his office asking HIM questions. LOL!

Thanks guys for the replies. Yea, even after 6 years it is an issue. I am being told I have a commitment to my unit and will not be "released" until it is over with. Somehow they are interpreting my UPT commitment as a commitment to my base and not to the Guard as a whole.

Unfortunately the IG might be the only one who can give me a truthful answer. The JAG agreed with me about my UPT commitment but said that they have no enforcement capability. I just want to gather as much information as possible before I hit the go button.

I like the people I work with, just trying to do what is best for my family.

This sounds like a job for your Congressional representative.

BTW Please name the unit so we can shame the commander.

I ran into similar attitudes back in the 1980s when I was trying to get a UPT slot. I had contacts in a MDANG unit and they warned me to beware of one guy in particular. They said he was bitter about not being able to get hired at any airline and took it out on the airline pilots in the unit. Since I was an outsider (enlisted in another ANG unit), and had the airline contacts, he treated me the same way.

I had to deal with an OPS officer who tried to threaten a new 2LT with a similar argument. Your CO sounds like he has a similar attitude.

I am worried about the same. Just moved to a different city and state after getting hired by a major and dont want to commute to both job but will stick it out if I have to in order to finish off 20 good yrs for the medical. If they told me I could retire right now with medical I would. Is there any early retirement being offered for guard guys? have 13 full time yrs so far. if not and I cant transfer (hell I will take an exec job for all I care) the current unit (after the way they have been treating pilots) will get all UTAs, a current pilot and NOTHING more. I have never seen people who preach we are a family and then turn around and stab each other in the back so much. Hell, we didnt even do it that much on active duty.

This sounds familiar. I don't remember the name/number of the regulation but the phrase "incompatible duty assignment" comes to mind.

It might be a NG regulation for ANG and ARNG.

Honestly, if I was your commander, I'd rather you leave so I could hire someone who lived near by who could participate more. He's being a douche and screwing himself in the long run.

Don't mean to hijack the thread but I've read into the Gold to Silver transition and was wondering if you got picked up for that, how does aircraft selection work? Can you apply to whatever guard unit you want and if you get hired, they send you to get qual'd in that airframe?
