definition of "overtime"
 
I'm helping a friend of mine with an insurance situation. He is a retired airline pilot and has been receiving long-term disability benefits.

The amount of LTD he receives is based on his "regular monthly pay" excluding overtime.

His CBA stated that he had a minimum guarantee of 72 hours of pay per month and that he was paid for every hour of flight time - all hours, including those over the minimum of 72, are paid at the base rate of pay.

The CBA does not say that any hours over 72 are considered "overtime" hours, however, his pay stubs do denote them as "overtime"

The question is whether those excess hours would be considered "overtime" for insurance purposes (the insurance policy does not define the term "overtime") -- most months, he had substantially more than 72 hours of flight time. If those hours of pay are part of his "regular base pay" then his LTD benefits would be much higher.

The funny thing is that the insurance co. is basing his LTD benefits on 80 hours of pay per month (as reported to them by the airline) and not the minimum of 72, but he normally flew over 90 hours a month so we would like the LTD to be based on that number if possible...
