Normal people pay taxes to the state where they earn the income not where they reside. If you live in New Jersey and work in NYC you pay NY taxes.
As transportation workers we have a exemption to that law if you don't do 51% or more of your work in one state. You then fall back on your residence to pay taxes.

Normal people will figure out which is most advantageous while remaining within the law and base their filing on that.

In most cases they won't have a option. It's a income not a residence tax. The employer will withhold based on where the income is earned.
Delta had a situation years ago where the state of GA realized that the pilots working in the training department did more then 50% of their work in GA. Massive back tax bills to all the instructors living out of state. Many lived in FL. They got a double whammy. The high property taxes in FL and having to pay GA income taxes. Massive exodus from the training department back to the line!

Law? Where can I find said law? I can't find it in the IRC.

Look at the previous page, comment number 20.

The applicable federal law for taxation of air carrier employees (pilots and flight attendants) is 49 USC section 40116(f).

Yes, I see the code but I'm trying to reference the "specific" Federal law
that allows for the tax in the first place as it applies to a private sector worker.
