I really appreciate all of the help. I've already looked into a lot of your suggestions. For the record, I was 21 years old when I got my DUI. I've looked into getting the DUI expunged and found that in Minnesota it is almost impossible. C172MQI, I went through the steps your talking about (it took six months and approximately 60 hrs of work) sent in a 100 pages of forms and $250, waited two months and got a two paragraph letter back saying that I was denied. I've heard the theories that Canada is cracking down on DUI entries because of the US's new policies on passports and finger printing but the explanation I’ve been given by Canada is the US recently began to share DUI information and therefore Canada officials, simply have to swipe your passport to find out if you have a DUI.
For clarification, I was charged and convicted with a 4th degree DUI (I was charged with long list of other things which were dismissed in the plea bargain. i.e. reckless driving). When I was arrested, I did not submit to a Breathalyzer (this changes the offense from a 4th degree to a much worse gross misdemeanor 3rd degree DUI.) But by pleading guilty I was sentenced to a 4th degree. My basic plan, at this point, is to apply to as many regionals as possible and see how many deny me out right. I'll keep you all informed on the progress.

The word he got during his stay was that Canadian Immigration Officers have a lot of leeway in enforcing this policy. The past 3 years they have become sticklers because of the the US's ridiculous policy of requiring passports when traveling between the 2 countries.

Note: If the DUI is over 10 years old, all is forgiven. Basically my buddy's 10 years was up before he ever got the VISA.
They do stop crewmembers, they stopped and detained me.

So do you think that once the 5 years is up, they'll accept your application? I guess they kept your $250, right?

USAToday ran an article on this recently. It's pretty ridiculous.

N49194, so you submitted your paperwork when you were eligible and it cleared through? How long did it take after you submitted to Canada?

Also, how did this issue (your record) come up in the interview? Did they really grill you on it?

I applied for a CANPASS instead of the waiver. At the time I was required to hold a CANPASS for a fractional that I was interviewing with or I never would have found out about this option. Prior to the CANPASS application, but after discovering the Canadian entrance issues, I did research on my conviction to be positive of the status of my record and I discovered that (through my own FBI fingerprint check) that my record was clean.

Being concerned as to why there was no record I made several calls to the state my driving offense happened in and never got a good answer as to why.

So I applied for the CANPASS and disclosed my tickets to them and that it appeared that due to complying with the courts requests my records were cleared. Within 6wks of applying I had my CANPASS.

Fast forward to my interview with SKW 1mo later. I was concerned about the Canadian restrictions and had a good friend who worked for them ask HR about the issue for me and they just asked that I brought all the documentation that I had. I brought the FBI record, the CANPASS and old records of the tickets in question. Let's just say that I have 2 alcohol related driving tickets that occurred in 1996 and 1999 so you can put this into perspective in regards to your question.

As far as the interview. The issues come up during the HR questions. They have to ask certain questions and one of them is if you have "Ever" had any misdemeanors or felonies. I was completely honest and told them about everything. Took all of about 30 sec and that was it. Not any questions; nothing...on to diagraming the electrical system we went..lol. There was so little concern I felt obligated to return to this issue at the end just to make sure they knew I understood the weight of my mistakes and irresponsibility of my decisions. Again they smiled and said no problem, go have lunch..lol. Was offered a class on return from the roach coach.

If you can't get the waiver I doubt you can get a CANPASS, but so long as your record meets or exceeds their rehabilitation requirements it seems that the CANPASS is a far more efficent way to go. It accomplishes the same thing.

Does anyone know if when going through immigration to Canada is it just your FBI background check that comes up in their system or something more like state or court records? Also, does it only matter for actual CONVICTIONS? What if you made a plea agreement in court that kept it from being an actual conviction but you still plead guilty and received court supervision for it?

Last summer Customs told us, flying 135, that it was any conviction, misdemeanor or felony and no time limit in how far back they would/could go. As stated earlier, it was in direct response to US Customs procedures, and it seems to be getting more stringent by the day.

One guy had a minor shoplifting charge from over 10 years ago, they denied entry, we flew him back to the states where he rented a car and drove across the border instead. Another had a DUI from over 10 years ago, same thing happened to him, so don't bank on the 10 year plan.
