True, in theory.
However I flew with a captain recently who said he called in fatigued once. Was suspended 2 weeks.
An FA I know called in fatigued (genuinely, too. Hotel was a party palace until 3am and she couldn't sleep; the previous nights of the trip had other issues depriving her of sleep).
Terminated immediately.
I've been advised by many to never call in fatigued.
