While the FAA and the company share some responsibility I think we need to step back. Even knowing what Atlas knew I'm shocked that this pilot was hired with the number of disclosed recent failures. Did affirmative action play a part in his hiring?
I'm all for trying to get a flight crew that reflects your clients. My wife was a military pilot and experienced discrimination. But at some point, a person needs to be cut loose. I remember a problem female pilot being shuffled along in the military. It really POed my wife as it gave her and the other females a bad reputation. "Oh... you just made it because you're female..." The same thing happened in medicine. She recommended a female resident be eliminated, but the higher-ups were afraid of a lawsuit (the resident filed one against her medical school) and passed her along. She never passed her boards, but she did graduate from residency, though late. My wife was livid. Guess who may be cutting on one of your loved ones? To this day mentioning her name sets off my wife.
My wife and kids are military. This easily could have been a military charter. Or if it happened a little later and plowed into a neighborhood...
I'm not sure of the solution.
I feel for the jumpseater and the captain. In my thousands of hours as a captain, I prepared myself for many things. The FO disconnecting the autopilot and shoving the yoke forward in cruise? I'll add that one to the list.

Yes other people were thinking that too. Rumor has it that it was closely scrutinized as a possibility.
