Pathetic. Utterly pathetic. Instead of being grateful for the professionalism and skill that got their a$$es back on the ground after a severe mechanical failure, they’re suing to get money.

I hate this society more and more everyday, I swear.

Think someone caught wind of the southwest incident someone’s sueing for.... “oooooo good idea!”

Trying to get emotional distress damages is next to impossible when you have a claim. This claim is a nothingburger. Actual physical injuries from the fumes that manifested well after the accident may have legs however.

Yup... have to show harm. Good thing is there is plenty of evolving parallel case law and precedent.

Also, if they got some of JB’s internal emails via subpoena, that could help them too. I saw they are using the “tobacco industry defense” that these “odors” are common and at “levels that are not harmful”. Yes, I know this was a smoke incident vs. the typical bleed air issue, but the root cause is the same.

One only needs to research Aerotoxic Syndrome to get a preponderance of research on the matter. There are more synthetic oil combustion products than just TCP.

The worst part is that you could be a world class triathlon winner then suddenly die from this stuff. The second and third order effects are quite difficult to trace but very real. People may ridicule California (including me) but their hazardous chemical warnings in airports are based on science. Jet fuel, hydraulic fluid, cleaning fluids, oil (dinosaur and synthetic), rain repellant (except for the Airbus kind), fire retardants, etc. are all toxic to us at the metabolic and genetic level. Personally, I don’t buy the arguments that there is nothing else available. Nothing is stopping manufacturers and air carriers from doing the R&D (think airbags).

I would think nothing would happen to him since he followed SOP and exercised emergency authority under 14 CFR. I kind of doubt he will be held liable. On the other hand, the airline and the manufacturer are fair game. Airbus can’t say the technology employing bleedless air conditioning doesn’t exist because the 787 has it. I believe Airbus has a similar engineering design for a bleedless system but no one wanted it due to the cost of retrofitting.

Also... inert fuel systems like military planes have, was a systemic deficiency mostly solved by requirement. This was a recommendation made after made for civil aircraft after Flight 800 (assuming it wasn’t a missile).

So, this lawsuit could solve a major industry problem if played correctly.

Oh, I was flying in the back one time. Minding my own business, when the airplane hit some rough turbulence. Scared me half to death.

It certainly was not my fault. Have to blame someone else. So I am go to sue the airline. Anyone have the mailing address for PanAm, so my lawyer can have them served with the lawsuit?
